Appeal court removes Iyiola Omisore from the Senate

The Court of Appeal, sitting in Ibadan yesterday, sacked Iyiola Omisore, Chairman of the Senate Committee on Appropriation. He ceases to be a senator of the Federal Republic of Nigeria. The three-member panel, headed by Clara Ogunbiyi, unanimously ruled that the April 14, 2007 election in which Mr. Omisore was declared the winner, was characterised by widespread irregularities and non-compliance with the Electoral Act of 2003.

Appeal court decides

Delivering her lead judgement yesterday, Justice Ogunbiyi said the petitioner, Babajide Omoworare, the Action Congress (AC) candidate in the 2007 election, had succeeded in six out of the seven reliefs he sought from the court. Apart from the first prayer, where the appellant wanted the Appeal Court to declare Mr. Omisore unfit for the election on the grounds of being impeached as the deputy governor of Osun State, Mr Omoworare's other six prayers, which essentially bordered on election irregularities and non-compliance with the electoral law, sailed through.

The Court of Appeal ruling overturned that of the Osun state election petition tribunal which had earlier thrown out Mr. Omoworare's petition seeking the nullification of Mr. Omisore election. In that particular case, the petitioner had posited that since Mr. Omisore was impeached as the deputy governor of Osun state in December 2002 for financial misconduct, he was not qualified to contest the election in the first place. He also alleged that widespread irregularities observed during the election, particularly in Ife Central, Ife North and Ife South, gave Mr. Omisore undue advantage over other contestants and led him to being declared winner of the election. He then asked the tribunal to void the votes in the areas in contention and return him the winner of the election, with the remaining votes.

Tribunal's decision

In spite of the barrage of evidences and many witnesses pooled to argue his case, the election tribunal held that Mr. Omoworare did not convince it and dismissed his application for lacking merit and upheld the decision of INEC to declare Mr. Omisore winner of the election. Dissatisfied with the verdict of the tribunal, the AC candidate took his case to the Court of Appeal, leading to yesterday's judgment.

In reaching their verdict, the appeal court judges seemed particularly miffed by the tribunal's misapplication of the judgement in the Buhari/Obasanjo case, a precedent that was the basis for kicking out Mr. Omoworare's appeal. Referring to the content of the judgement read by the chairman of the tribunal in dismissing Mr. Omoworare's petition, Justice Ogunbiyi said since the panel had established that there were widespread irregularities and non-compliance with the electoral laws which INEC itself did not object to, the tribunal erred by upholding the election of Mr. Omisore.

The Court of Appeal therefore set aside the election of Mr. Omisore but declined to declare Mr.Omoworare winner, arguing that such a pronouncement would amount to allowing him to benefit from illegality. Justice Ogunbiyi ordered INEC to hold a re-run election to fill the vacant seat within 60 days of the judgement. Modupe Fasanmi and Sidi Bage, the two other members of the court, took turns to support the lead judgement.

Mr. Omisore was the flagbearer of the Peoples Democratic Party in the April 2007 election for Osun East senatorial district and was so returned by the Independent National Electoral Commission (INEC) after the election.

Reaction

Speaking with reporters after the ruling, Mr. Omoworare said he was happy that justice came his way at last. He said though the journey was tortuous, his points were eventually proved. The AC candidate, however, expressed fears over the possibility of holding a different election from the one nullified by the Appeal Court. "Are we going to have a free and fair election if this election is done again? I can't answer the question.

Nigerians and the people of Ife/Ijesa should answer the question," he said. "I have always said that people should resist people stealing their votes.

Stealing of ballot boxes is worse than armed robbery because the effect is monumental. It affects children yet unborn."

Are you sure Iyiola Omisore would n't be heading to the Supreme Court; and between the time he gets to the Supreme Court and the time the court adjudicate on the matter, he wouldn't have completed serving his time in office as a senator and chairman of the Appropriation Committee? Or is the Appeal Court legally or constitutionally the end of the road in the matter?

Good judgment coming from the wise men of the Court of Appeal. But would INEC conduct a free and fair re-run election? The answer is a capital NO judging from their antecedents in past re-run elections. My admonition is to call on the people of Ife North, South and Central senatorial districts to make sure their votes are protected during the re-run. Time will tell.

This is another giant stride by the Nigerian judicial system.However, I think our learned justices 'erred' by not declaring Mr Omoworare, the AC candidate winner.The justices did not finish their work!If it was so he will not benefit from illegality, then what have we got to say about more than 90% of our political office holders from the president down to the councillors that are benefitting from illegalities? Besides, the learned justices have still left a room for some innocent Nigerians to pay with their blood due to some die-hards who will want to force their will on the electorates during the re-run election.

Tata...the same abracadabra is likely to happen again? I don't understand the part that the Court said they will not declare Omoworare the winner. It must be that after nullifying the votes assigned to Omisore the Crook, Omoworare did not have the number of votes sufficient to have himself declared winner. ..there is a growing trend of judgements coming from female judges in our justice system..., first is Bode George, Now Omisore...Kudos to such women of integrity who will not mortgage the future of their unborn grandchildren! Time is of essence, but such judgement will go a long way to discourage those who plan to rig elections in 2011 and beyond..God Bless Nigeria.

Since the judgement was in favour of AC of course it is a good judgement. Any other way would have been injustice. AC members and their press sympathysers should be happy. The same court will be castigated for giving a judgement against AC the next day. It happened in Benin.

@ERA: I agree with you. If Omoworare wins he gets his 48 months as a Senator (e.g. Peter Obi - Anambra). If Omisore wins the re-run, he is also entitled to 48 months + 30 months he has already whacked (e.g. Segun Oni - Ekiti). This is perfect tenure elongation well mapped out. I hear he is warming up or has signified his intention for 2011 Governorship elections in Osun State. We always say that Nigeria has a corrupt system...I totally disagree with that. We need good orientation and I think this is the only way we can strive as citizens and make meaningly impact in this country. As individuals and with our level of education (whatever level), we can influence the Nigerian system positively or negatively. So if a majority of Nigerians are corrupt, then the Nigerian System would be corrupt and vice versa. Further, a man who was in prison should never be allowed to contest for a political post in the first place. Where were our judiciary, Police force, Security Officials and the rest when this was happening? This goes a long way to show that we've got no or low orientation in this country. We are still living in the stone age in Nigeria. I always feel sad about this country called Nigeria. I can never say 'am proud of this country when almost everything is falling out of place. Its like your son/daugther keeps failing in class and you say you are proud of that child. It is a pity... GOD SAVE NIGERIA.

The court has done its own part. The ball is now in INEC's court. INEC needs to purge itself of satanic and fraudelent manipulation of elections. I don't think there will be any change in INEC's attitude because it is the same old wine in old bottle. Can Iwu change? Time will tell. How many re-run elections has PDP lost? Let's cast our mind back to gubar re-run in Cross-River state and the rest. It has followed same pattern - PDP abracadbra rigging exercise.

Dare Taiwo and uyii edo: The Supreme Court is also an "appeal" (or "appellate") court. In appeals from petitions concerning elections conducted by INEC (except presidential elections), the Court of Appeal is the last bus stop. Only in petitions concerning presidential elections is the Supreme Court the court of last resort. Can a litigation lawyer reading this please confirm.

I don't believe that Omisore can re-contest the election again. One of the grounds for his removal, which the Appeals court upheld, was that he (Omisore) was inelligible to contest the senate seat in the first place because he had previously been impeached as deputy governor on grounds of financial impropriety.

excellent judgement, since the said election was characterized by illegalies of all sort the judges were right not to declare either of the candidates winner. INEC was not the perpetrator of stealing of ballot boxes and other vile notice in Nigeria elections but politicians. I am apolitical. Justice Clara Ogunbiyi did not go fare enough. INEC is not credible and incompetent to conduct a fear election. She should have just declared Omoworare the winner and let him assume the post. Obasanjo and INEC course this whole mess, it is a shame to see that election that started in 2007 is still on going after two years.

Fair judgement but I cant see this guy called Omoworare wining any election. Omoworare spent 8 years in Lagos houe of assembly, he doesnt have any political base in osun state-they only rely on Lagos State Tinubu looted from Lagos State to force their way into everything in the S/west. No knows Omoworare in Ife and Ican bet anybody he will loose again, local politics and election goes beyond sitting in Lagos and sponsporing propaganda in the media..how many local people have access to news being aired in the media. Osun people need a change but the chaneg we need is not people like Omoworare, they should let other people too contest, the country belongs to all us. After serving in Lagos for 8 years Omoworare wants to come to Osun again ..haba and after he will want to be Governor, so the rest os us are slaves abi.. Future, Dewale and Omo Eko, the issue is not about Tinubu or Omoworare, it's about conducting a free and fair election, so that people can genuinely choose those who will represent them. If Omoworare is going to lose, let him lose because he has no grass root support, not because of ballot box stuffing or thuggery. If the PDP which I know you all belong to is that popular, why does it result to this evil way to win election. Every time I hear the name, I ask myself how did Bola Ige the Minister of Justice, of the world's most populous Black Nation die? Is his death linked to the politics of Osun State? part of which the appeal court has passed judgement today. I mean the impeachment saga. and the AD politics. Unless we answer the question, the ghost of the dead will continue to haunt the guilty until judgement is fully applied. Let's face it justice will still prevail in the end it may take 30years or 30days!!!

The judgement as good as it might seem, is senseless as far as i am concerned, Senator Omisore is just about to flag up is campaign as PDP governorship candidate for osun state, now that he has the opportunity to remain the senator for another 4 year (abeit via rigging) he may as well sit tight in senate.
