Goodluck Jonathan, the 52-year-old zoologist and former teacher, is now the Acting President of Nigeria following separate resolutions by the Senate and the House of Representatives yesterday. He will remain in that office until the ailing President Umaru Yar’Adua shows he is healthy enough to resume office.

More than 20 state governors who arrived the National Assembly shortly after the resolution, congratulated the Senate on the decision. The chairman of the Governor’s Forum, Bukola Saraki of Kwara state, who spoke on their behalf, said the decision “makes us proud” and “is a victory for all Nigerians.”

The Senate voted on the resolution to empower Mr. Jonathan as the Acting President and few hours later, the House of Representatives did the same. All these happened exactly 78 days after Mr. Yar’Adua left Nigeria for medical treatment in Saudi Arabia.

First broadcast

Later in his first broadcast to the nation at 10pm yesterday, Mr. Jonathan said “I am deeply humbled and honoured by this great call to duty.” He commended the National Assembly for “showing great courage” in passing the resolutions making him Acting President and wished the ailing President quick recovery. He said the Federal Government “ will take every step necessary to consolidate the gains of Amnesty in the Niger Delta and execute the post-Amnesty programme.” He also sympathised with victims of the recent Jos crises saying “culprits of the heinous crime... will face the full wrath of the law.”

Mr Jonathan also spoke on the anti corruption efforts of the Federal Government saying “the war against corruption will be prosecuted more robustly. We will therefore strengthen the capacity of the anti-corruption agencies and give them a free hand to prosecute the anti corruption war.”

The Senate resolution

The first part of the Senate’s two-pronged resolution reads: “That the Vice President, His Excellency Dr. Goodluck Jonathan, GCON, shall henceforth discharge the functions of the office of the President, Commander-in-Chief of the Federal Republic of Nigeria as Acting President.”

The second part of the motion said the Vice President will cease to discharge these functions when Mr. Yar’adua transmits, in writing, to the Senate President and Speaker of the House of Representatives, a notice that he has returned from “his medical vacation.”

After two executive sessions, the House of Representatives also adopted a resolution making Mr. Jonathan Acting President pending the return of Mr. Yar’Adua from his medical trip to Saudi Arabia. The resolution, which was read by the House leader, Tunde Akogun says, “That for the peace, order and good government of the Federation, and consistent with the judgements of the courts, the Vice President, Goodluck Ebele Jonathan, GCON shall assume full presidential powers as acting president, pending the return of the President, Alhaji Umaru Musa Yar’Adua GCFR to office.”

Members voted unanimously for the adoption of the resolution when the Speaker, Dimeji Bankole, put it to vote although there was some uproar and drama. The success of the resolution was preceded by two executive sessions which were characterised by intense disagreements.

Full powers

Mr. Jonathan, according to the Senate resolution, assumes full presidential powers and can officially communicate bills and letters to the National Assembly.

While awaiting yesterday’s decision, lawyers had expressed fears that such a legislative resolution may be controversial considering the fact that the source of its authorization is not legally firm enough to empower the Vice President to act.

Section 145 of the constitution requires that a holidaying or sick president sends a written letter to the leadership of the National Assembly before the Vice President can legally act in his stead.

The Senate had based its decision on the purported interview Mr. Yar’adua had with the British Broadcasting Corporation in January 2010, where he supposedly promised to return as soon as his doctors considered him fit enough.

The Senators said in their motion that the Senate President and the Speaker of the House, had read the declaration of Mr. Yar’adua in the media, and will assume it to be the required transmission - which implies that section 145 has been “complied with.” “If you go online, you will see what was said,” Mr. Mark said in response to Garba Lado (Katsina state), the only Senator who raised a formal opposition to the resolution.

Mr. Lado argued that some Nigerians, including lawmakers, had questioned the authenticity of the interview, and as such could “not understand the kind of decision where voice interview can be interpreted to mean a written declaration.”

In support of Mr. Mark’s explanation on the motion, which was hugely supported during debate, Deputy Senate President, Ike Ekweremadu, said the law gave no details of the mode of communication required except in asking for a written submission from the president.

“Section 145 does not require the president to sign anything, the form is not prescribed,” he said. “If the president had sent a text message to the Senate President and the Speaker of the House, section 145 would have been fully complied with. In addition, the interview was transcribed and was written on the net.”

Ahead of the decision which the Governors’ Forum called ‘historic’, Senators shut themselves in the chambers for preparatory discussions that lasted more than 30 minutes.

Back in the open chambers, the weeks of intrigues that have surrounded the controversial transfer of power to the Vice President, culminated with majority of the Senators expressing their support for the decision.

Save for the few amendments on the motion, which included the proper spelling of Mr. Jonathan’s middle name, Ebele, and the inclusion of the “Armed Forces” in the designation Commander-in-Chief of the Federal Republic of Nigeria, the Senate President spared no room for discussions on the motion.

Doctrine of necessity

Mr. Mark seemed to have anticipated the many questions which the resolution might raise when he declared that the upper chamber acted according to the ‘doctrine of necessity.’ “There comes a time in the life of any nation when people must stand up for the truth,” Mr. Mark said, while addressing the visiting Governors after the resolution. “We are not to concern ourselves with all the technicalities. The doctrine of necessity demands that we do what is necessary that was not foreseen by the constitution.”

The Senate, he said later in a speech, had acted with “patriotism, wisdom and collective national interest.”

Joy Emordi and Iyabo Obasanjo suggested that the Senate’s resolution should be made clear enough to demand that Mr. Yar’Adua can only resume office after first returning to Nigeria and second, proving that he is capable of performing the functions of his office.

Mr. Mark ruled that if the president “transmits the letter, we should assume that he is capable.”

Jonathan Goodluck - Mr. Acting President of Nigeria (my dear country) does have good luck or is an extremely sharp guy. I will say (for the minefield of Nigerian politics) the latter. He managed to be non-controversial/unsoiled in Bayelsa State and calmly took over from you know who, when all hell broke lose. Now he is "calmly" taking over from you know who. Again? Did we hear any controversial remarks from this man? Nope. From the newspaper reports, he did not even utter a word when our dear Dora Akunyili was reading/presenting her memo that woke up our Nigerian leadership - FEC/NASS. The man at the eye of the storm managed not to alienate anyone on both sides (assuming there are only two sides of this saga)...till we all have "smoothly", by Nigerian standards, shooed him into this exalted position of leadership. Let us just watch him play this Nigerian political game which he has proven to be pretty good at; up to this point in time. Preparation + opportunity + ?something else ==> some people call this Good Luck. Let us all pray for good luck for Nigeria.

Arrant nonsense from an incompetent National Assembly. It took them 78 days to do what they deemed "...necessary that was not foreseen by the constitution,” the Senate President said. Any sane person will deduce from their lawless act that they are not fit to be in the National Assembly. Yar'Adua is incapacitated and the man should be told in clear terms to go and look after his health. Period.

the tense atmosphere over nigeria in the last fortnight scared me almost to my wit's end. Resolutions by the two national assemblies have made the dangerous cloud over nigeria to disappear.Both Yar'adua and Goodluck are scientists of value. Their action is illegal. Yar Adua should either transmit a letter saying he is incapacitated or the legislators should impeach him. That is what the tissue paper called constitution says. If they decide not to follow it, who cares after all, it has been bastadized by the cabals.

@Omo Alhaji, the lawyers concerns are correct and rightfully so. While this should be something we should be happy about, at least our nascent democracy will not be thrown to the savages but what is worrisome here is the initial denial of their responsibility and that is where the contradiction and the fears of lawyers come to play. Initially,the lawmakers hid behind "provisions of the constitution" to state their incapacitation while the lawyers argued that they could actually act on the said matter in favor of a transmission of powers since the president had already transmitted the said "letter" by that BBC interview - which has served unfortunately as Yarádua's undoing - though it is unorthodox. They stood behind Yarádua at the time most likely because they were afraid of a backlash should the man return and threw all sense of responsibility and honesty to the dustbin. Frankly speaking, there's no big deal in the transfer of powers to the Vice - President as acting president until his boss returns but the senate and reps handled the matter quite shabbily. In all honesty Yarádua can be accused of misconduct and unruly behavior, although many may argue that the man had no control on the state of his health and that he was indeed a victim of "incontrovertible" circumstances but the manner in which his aides treated the matter states clearly that there was something sinister going on.We should thank God however that reason has prevailed and the plot or ploy to hold Nigeria ransom by some faceless cowards has come to naught. I hope Nigeria will learn from this debacle, meanwhile I wish Goodluck the best of his luck, he seems to have luck on his side. Lets hope it doesn't run out. God bless the Federal Republic of Nigeria. Amen

The resolution by NASS is illegal - QED! The BBC interview is not the same thing as a letter to NASS and cannot even be held to suffice. The Senators themselves lend credence to this fact by: i) Passing a resolution calling for Mr President to transmit a letter, even after the said interview had been publicised ii) stating cateogrically in their second resolution yesterday that Goodluck Jonathan will only cease to act whenever Yar Adua returns and writes a letter to NASS. Yar Adua might as well grant BBC another interview saying he is well and fit to return to work! The only options available to fix this problem consititutionally are: i) for the FEC (or EXCOF) to do as required by S. 144 ii) for the Senate to put a timeline to their resolution on a letter from Yar Adua in compliance with S. 145 or otherwise face impeachment on grounds of gross misconduct and brazen violation of the constitution. I just hope the VP is not being set up for impeachment by the same people that have given him this greek gift!

Congrats Mr. President. The likes of Aondoakaa or ''I-DON-CARE'' and others are confusionists. Their days are numbered in the new dispensation. He should be one of the first to go with cabinet reshuffle so that he can join Yar-Adua in Saudi Arabia to give him moral support. He is a liar and not a good lawyer. I dont know what qualifies him for that kind of exalted position where there are so many credible SAN in Nigeria.

@Prince. l agree with you if this is not a set up indeed. If Jonathan is impeach for whatever excuses, guess who will be president by constitution, is David Mark. If you know DM history from even the Shagari administration days thru the Babangida years, you will be afraid for Jonathan. DM is said to be so ambitious, it took the efforts of the Col. Abubakar Umar and his cohort to allow Babangida as President contrary to original plan of DM been the HS. He had another move in the making when Abacha got wind of it thru intelligence and forcefully retire him. We all should PRAY for Jonathan becos is not yet UHURU. GOD BLESS NIGERIA!

Thank God for God! Ah, Nigeria now has a head, a rudder, an anchor, a man at the top, a president after a long 78 days of visionless movement and missionless outing! We can now officially receive, give, transmit, communicate, dialogue and negotiate our stand like other sane nations that their heads have not been exiled in the comity of nations. Congratulations Nigeria! However, I will want to point out to the entire world most especially those who care about the future of this great country, Nigeria, that TRUTH built on LIES is nothing but an ORNAMENTED LIE and the future of it is but calamitous. A house built on a quicksand, no matter how beautiful it is, cannot endure storm. Why then should such an unprecedented and historic event that ought to shape the history of this nation and placed her on a better pedestral be predicated on mere lies, illegality, unconstitutionality and egoism by these lawmakers who are suppose to be the first defenders of the contents of the sacred constitution and our national interest. If I may ask, "Who granted that BBC interview, whose idea was it, for what purpose was it granted, who were the supposed audience, when did the inteviewed become the prime minister of Britain, were the audience suppose to be britons, while chose BBC medium and not Al Jaceria, why not video interview to dismiss all doubts? These and many more the questions arising from this instrument that the NASS has considered good enough to transfer power. Although I wish the sick man a quick recovery, I want to tell fellow Nigerians that considering his long absence from duty and non-transmittance of power, the LEAST person with the INTEREST of Nigeria at heart presently could be no other person than the Mr President. My sincere advice to Mr Goodluck is that he must be careful because he is treading on a delicate pedestral and dining with vipers. Watchfulness must be his watch word. O God, help Nigeria and encourage Nigerians to take our destiny in our hands and confront these Goliaths in our midst. Nigeria shall be FREE!!!

Now that Jonathan is acting president let us see how Nigeria will change. Hiss!!! Yar'adua's absence has not in anyway affected the common man and so also is Goodluck's assumption of presidential powers. Life is still how it is,no light,bad roads,wicked police,unprofessional and corrupt workforce etc. All those congratulating him here are just customers to local media who were taken on a spiral journey. The real people who should be congratulating Jonathan are those near him (david marks and akunyili's) who will eventually benefit greatly from the much awaited oil block lease/sale.

They have so pushed us to the wall that we would accept almost anything, legal or illegal! These guys are a joke! The BBC interview would suffice? How did they prove UMYA really spoke with the BBC? It's just insane. They should have given him an ultimatum to transmit the letter and then face impeachment if he doesn't comply. We are in as much trouble as we were, possibly more. This country can only be free when we have confidence in the rule of law!

Dear Acting President Goodluck Jonathan, Please do not take the bait. Do not allow the cowards to further complicate our already complicated polity, as every action you take could potentially be declared illegitimate sometime in the near future in accordance with, you know it, The Rule of Law. The NASS could easily have impeached the President for gross misconduct in his refusal to follow simple rules laid out by our constitution, but they didnt. The Ministers that sit with you on an almost daily basis could have availed themselves of Section 144 of the constitution but they did not, despite the face saving (ass covering) suggestion given to them by the ever-wise Atedo Peterside. Do not get me wrong, I am as happy as any Nigerian could be about the prospect of moving forward, but to do this on a potentially illegitimate basis just feels like I'm being taken for a ride again. Remember how we all justified the presence of a new military ruler after we have gotten over the initial shock of a coup? It was a new beginning and a departure from the old ruler, but we all know how far that got us. I refuse to be labeled a fool and I believe you are not. Please Mr. Acting President, show that in addition to your patience and good fortune you have some number 6. Let your first move be to legitimize your rule. I suggest two options: A. Send a team to Saudi Arabia to bring a full and proper report of the state of the health of the President. I cannot imagine that the Kingdom of Saudi Arabia, will put the wishes of a First Lady ahead of the demand of a whole 150MM strong nation backed by the instruction of the Acting President. If you reach out to our Ambassador in Saudi Arabia and to the King himself, I'm confident that they will grant whatever you request, especially if its something as simple as getting a detailed report on the state of our president for the benefit of the entire nation. Tell them its a matter of National Interest and Regional Security (God knows we dont want Al Qaeda coming to train anything in Nigeria) B. The second option requires some political savviness. You see those Ministers that are now greeting you Congratulations....... Section 144. No need for plenty talking. There is no leader chosen over us that God did not first approve of. God is with you. There is no need debating this issue, Goodluck Jonathan is still the Ledader of this country as Acting President. When Yar'Adua is ready to resume he should come back during day time with full television coverage so Nigerians can ascertain whether is the one and if he can still rule this country. Secondly, after returning he should communicate to the National Assembly which empowered Jonathan to act as President, and until then all those spreading the rumour of his return should be arrested starting from his wife. I don dey even suspect say na she don turn the man to vegetable
