Senate asks Jonathan to takeover

Nigeria's Senate on Tuesday passed a motion that Vice President Goodluck Jonathan should be acting president in the absence of President Umaru Yar'Adua.

The motion, backed by the majority of Senate members, puts further pressure on Mr. Yar'Adua to formally transfer powers but there is no provision for such a move by the upper house of parliament under the terms of the constitution.

"The Vice President ... shall henceforth discharge the functions of the office of the president, commander in chief of the armed forces of the federation, as acting president," the motion said.

Mr. Yar'Adua has been in Saudi Arabia for more than two months receiving treatment for a heart condition but has not formally transferred power to Vice President Jonathan, triggering confusion over who is in charge.

The Senate passed a second motion that Mr. Jonathan would cease to be acting president when Mr. Yar'Adua transmits a letter to parliament saying that he has returned from "medical vacation".

The Senate said it based its decision on a BBC interview with the president on January 12. In that interview, Mr. Yar'Adua said that he would return to work once his doctors cleared him.

"The BBC interview granted by the president is as good as the letter envisaged in the constitution because if you go onto the Internet, you will see a copy of what he said," the Senate president David Mark said.

What are the statutory and constitutional requirements? Can they arrogate the power to authorize the VP to act to themselves. It simply has no precedence or constitutional support. I simply think that they are acting in a gutless manner. The right course of action provided in the constitution is for them to either initiate an impeachment proceeding against the embattled president or urge the FEC to act decisively as empowered in the constitution. This action would simply entrap the VP and my personal advise is for him to seek the advise of a constitutional lawyer. If he decides to upgrade his status to that of an acting President, then his actions would be contestable in the courts. The VP should toe the line of honour and not allow himself to be hoodwinked. This whole course would compound the situation and create an illegality. The constitution is clear on how to proceed and we should please prevail on our political class to rise to the call of duty. The whole charade continues! This augurs well for our nascent democracy!!

What is all the excitement about? Both Yar'adua and Jonathan are products of a very corrupt system. Obasanjo foisted them on the Nigerian people, they have NO mandate. Jonathan is compromised, his ascension to the Presidency will not change anything, it could even make things worse. My University teacher once told us a class that when a father pays the child's school fees, he needs not be applauded including himself(My teacher) cus he's(a father)only discharging his responsibilities. The senate should simply do the right thing and release Yar'Adua from office.The should stop beating around the bush, going round and round. There are steps stated in the constitution that should be taken and we expect them to take such steps now that it's obvious that Yar'adua flagrantly disregarded the constitution. How can Jonathan act effectively and carry out decisions with out always looking behind his back, expecting Yar'adua any minute to come back and accuse him of seeking to take office from him?

This is a poser. God forbid, if Jonathan is killed or incapacitated like his boss, what happens? David Mark becomes the president. How long do we have to wait for the president? We still have the right to know what has happened and is happening to Yardie boy. My suspicion is that we have been hoodwinked to divert attention from Yardie. SOMETHING IS FISHY. We have been robbed by the Feeding Republic of Nigeria (FGN), the People's Republic of Nigeria (PRN) will revolt.

The constitution says the VP can only assume the seat of the President : 1. transmission of a letter from the President to both houses informing them of absence or incapacity; 2. Declaration of the President as incapable of discharging his duties by reason of incapacity by the ECF 3. or impeachment by the both houses. So where is the place of a resolution by a senate! n

Some days ago, PDP-Chairman wrote a letter and submitted to the legislators saying Jonathan should be made Acting President pending the the Time Mr. President will be back from saudi. Thereafter the letter was no accepted by the legislators. Just today, the same decision was taking by the house of senate, why cant the H'Senate impeach Mr. President for not writing the letter before traveling thereby violating the constitution. The senate lacks the constitutional powers to instal Jonathan as acting president. They are only politicizing the issue. The ONLY option left for them is impeachment and they shd explore it. They can pass a motion advicing Yaradua to respect the constitution but they cant enforce it. Let them impeach Yaradua for absconding from office for 78 days running, period!

Since the interview granted BBC by our ailing president is enough letter for the senate to pass a resolution empowering Goodluck to be Acting President according to the senate president, why has it taken them so long to act, they should have saved this country all these embarrassment. This resolution is simply an aberration. It is not known to the constitution, contrived by the Governors to one; tie Goodluck Jonathan to the apron strings of the Senate, two; create grounds for impeachment of Jonathan when and if Yar'Adua comes back; three, ensure that Goodluck Jonathan quits the stage under blackmail come 2011. The simple thing would have been to commence impeachment proceedings against Yar'Adua for shunning senate's directive that he transmit a letter of medical vacation! There is nothing to celebrate yet in all this. It seems our representatives are doing Yar'A dua a favour. It is not a thing he bought or acquired through any personal effort of his. There can be 1000 capable Nigerians who can be President. If he is indisposed let him leave. He cannot claim to love Nigeria more than himself. If truly he is a 'servant leader' he can step down as Nigerians are worse off with his servantship. He has not and cannot pretend to be doing Nigerians a favour by being President. In fact the last three years has been a torpedo of a sort. The right thing is yet to be done. The options remain; 1. FEC acting 2. Handover letter from Saudi bed and 3. Impeachment. The actions of the senate are not legal. What they should have done was to initiate impeachment proceedings to force Yar'Adua to write the letter. Not to now hide behind a BBC recording. And like countryman said, this is an unconstitutional act because they are not empowered to do what they have done. Donald Duke said it recently that Goodluck himself should have taken over as acting President months ago based upon the doctrine of necessity. But then again this is Nigeria. In my humble opinion senate lacks the power to pass the motion empowering Jonathan as the acting President. They can only advise the president which they did and the court says transmitting a letter via president to the upper legislative chamber is at the discretion of the president. The only option left at the doorstep of the Senate is to impeach and that takes a rigorous step to achieve. Both parties are being political in their approach to solve the impasse. The court ruled that jonathan can perform presidential duties pending the arrival of the president.

1 question for all those who cry foul over what the senate has done: if the 3 conditions set out by the Constitution are unmet in any case, what do we do? Say the Pres falls into coma in his office or is kidnapped by an enemy of the Nation, which means he cant transmit the letter and has not committed an impeachable offence; if then, the ECF with the likes of Aaondoaka, declares (as they did in this case) that though their boss is in coma (or captivity), they do not think he is incapable of continuing, what shall we do? Indeed, beyond rhetorics, what the senate has done, is not just expedient, but does not in any way violate the constitution. Dont be decieved by what socalled legal experts will say. The constition is not one complex piece of legislation; its written so simple so that every citizen can understand and abide by.

I also read the few thinking ones who know that the Senate.s action is still the garbage Nigerians are fed daily. The National Assembly action is in order. S.145 says ' ..transmit a written declaration', not a '..transmit a written letter'. Mr Ya'Adua made a verbal declaration and was transmitted both in 'audio and written ' forms by the media, and the Senate President and the Speaker have both acknowledged the receipt of the 'transmission'. So what else is the issue. The doctrine of neccesity has also help in curing any perceived inadequacy. I challenge any one to test this action in court. This is a victory for our democracy and the resilience of our people. So Jonathan has no choice in this matter.

We are a very illiterate people. The very reason that Yar'Auda failed to relinquish power is because we think "acting" means substantive. He is wrong, and so are all of you. Acting means A-C-T-I-NG! By celebrating and calling Goodluck President, we make the mistake that power has been taken from Yar'Adua. That's simply stupid. If I go on leave and my assistant acts in my capacity, it does not give him my post. He still retains his position, acts for me, and returns to his position when I return. He is not officially president. He is Vice President. However, if Yar'Adua resigns or dies, then Jonathan becomes President, and you can celebrate that a Deltan has become president. For now, he hasn't. How can we blame Turai? Just like most of you are, she is misintepreting the significance of handing over temporarily to the assistant. As long as we think like this, the nation is in trouble. It should be a matter of routine that the president or governor hands over to an assistant to act temporarily. We make this a big deal, confuse the system, create unnecessary problems and compound our problems because we are just so silly.

Oh boy, this can't be good. Why do I have a feeling that the problems in this fragile democracy (say that with a straight face I dare all of you) is in for a dangerous bumpy ride? This is really confusing. I believed that constitutionally the vice president should assume duties in the event that the president cannot. There is one very minute problem though; WHAT THE HELL IS GOING ON?! Let's see, an indisposed president not willing to delegate responsibilities to his Vice. CountryMan and other naysayers: There is something in law called the Doctrine of Necessity, which says, echoing the words of Henry Bracton: "...that which is otherwise not lawful is made lawful by necessity...". If the ultimate purpose of civilian democracy is to secure the "peace, order and good governance" of the Nation; if in all things, the will of the people must continue to be the ultimate decider; and if the "well-being of the people is the supreme law"; then the invocation of this doctrine by the only constitutional gathering of the people - the National Assembly. Read the overwhelming trend of the comments before and after yours. They agree. Therefore, in this instance, the resolution is well made. Indeed, there is nothing to celebrate in this action that was wrung out of an unwilling National Assembly after much dissembling, hubris and sheer humbug. I suspect indeed that they were only acting out of fear of impending military decisiveness. Certainly, the Turai Rearguard will fight back and Goodluck's every action will be challenged. Still, democracy has survived attempted strangulation and we will emerge stronger for it. The past three days have been cathartic milestones in our political history. The rudder of our battered ship of state is turning ever so slowly, but surely, in the right direction. The seas are still very rough but we will make landfall in Canaan. There will be no martial music, CountryMan. Tufiakwa!!!!

Fellow Nigerians, what are you rejoicing about? My "gut feeling" is that there is more to come. The curruption in the so called "NIGERIAN GOVERNMENT" can be likened to a Cancer that will take highly skilled and technologically advanced medical practice to cure! Nigeria that used to be respected in Africa has no respect anywhere in the world! We have a cocnstitution, yet some dubious individuals have been sitting around looking for ways to turn things to satisfy their usual selfish nature. What are we rejoicing about? The first Black African President of America decided to visit Ghana when in history Nigeria would have been the first choice. There was no Presidential defence of Nigeria when the Nigerian attempted suicide bombing. We have so much petroluem not to talk of other natural resources to make Nigeria as develped as the western world yet our people live in poverty, we can provide electricity to neighbouring countries yet we are in constant darkness, continuous environmental polution by noise and dangerous gases from generators. No roads, state of Medical facilities is digusting, no security as thieves are more equiped than the police. I can go on and on about the woes of Nigeria and yet some of us are rejoicing over a decision that is still questionable. When are we going to be free from the governance of the stack ilitrates and the educated ilitrates? Today, I stand by the word of God that all in government that makes life difficult for less privileged Nigerians,will face the wrath of God........ God will bring you down, he will snatch you, tear you away from your abode and uproot you from the land of the living. Ps 52, Vs 7. That is for all the wicked people in government. Nigerians deserve more than what they get from you brood of vipers!!!!

In all the rejoicing that a Niger Deltan has come to rule, that is not the end of it. If he does not perform then of what point was it to have had him. Let us focus on what he has to do and not where he is from. That is what has caused all the problems and brought us to where we are presently. The Nigerian constitution is fundamentally flawed. According to section 144 and 145 combined: It is either the president transmit a letter of vacation, or that the FEC decide whether he is capable or not or that the senate moves for an impeachment. The President is unwilling to transmit a letter. The FEC are officials who are selected by the president. How in hell will anyone betray their boss in this type of situation? I think this shouldn't be a decision to be made by the FEC. it should be made by a group of people who are actually voted into government positions like the senate. In the case where FEC isnt willing to do the right thing, the senate should have moved for impeachment as this is the only way the senate can remove the president from power. I think the constitution should be amended, esp section 145 which should enforce that either the president must transmit all the powers to the vice or the vice should automatically take charge in the absence of the president.

two wrongs don't make a right. Isn't a written declaration needed? If not, aren't there clear rules; either within the constitution or within the Senate house rules, about how information from the Presidency to the Legislature is transmitted? What's the constitutional role of the Clerk of the Senate in all this? This motion brings up more questions than it answers! As per the 'the doctrine of necessity', it would seem this so-called doctrine was meant to be used under periods of extreme duress, and when the law/constitution was not expressly clear, but in this case, both the law and constitution are expressly clear on how a President can assume office. This motion has once again made our government a laughinstock. It will be bad for Nigerian democracy if it sails through. It may even precipitate a military take-over, and an abolishment of the constitution that it seems is so hard for us to follow.

Am happy that our future is determined by our constitution and not with us killing each other. It’s a step in the right direction and we can only get better. It’s an important part of democracy for our constitution to be continually reviewed and amended as the need arises. Please Nigerians stop complaining and whining it’s not only up to our leaders to get it right we need to play our part and its not by constantly running them down. The National Assembly action is in order. S.145 says ' ..transmit a written declaration', not a '..transmit a written letter'. Mr Ya'Adua made a verbal declaration and was transmitted both in 'audio and written ' forms by the media, and the Senate President and the Speaker have both acknowledged the receipt of the 'transmission'. So what else is the issue. The doctrine of neccesity has also help in curing any perceived inadequacy. I challenge any one to test this action in court. This is a victory for our democracy and the resilience of our people. So Jonathan has no choice in this matter. I agree with you. In the court it is dully accepted and I think by them the "Senators" sighting this in their resolution showed that they are covering asses well. For those who set up this interview will not come out at last to argue against it, they too digged a hole for them selves. Kudos to the patriotic Nigerians. Prof Dora your one in a millions.

This is no victory for Nigerians. The Senate should follow the constitution. There is nothing like the Senate asking the VP to become acting in the Constitution. In the absence of Yar'adua writing a letter, he has to be impeached for Jonathan to take over. If they want go jejely, then let them give Yar'adua people 2 days to produce the letter or have him face impeachment on Friday. NIGERIA;GOOD PEOPLE, BAD GOVERNMENT.

I wish to state categorically that this is a victory for Nigerian civil society. We are FINALLY taking our future in our hands!!! This victory for further entrenchment of our democracy was made possible by various groups in civil society such as the press(NEXT, you guys were great!), groups such as Save Nigeria Group, the Nigerian online community(local and diaspora) also one must commend the military for staying out of this also. Now we all have to jealously guard our democracy by holding the leaders accountable. We must continue to strengthen this democracy by demanding the changes we seek. We can no longer afford to 'Siddon look'. This is what happens when people stand up for their rights, the democratic evolutionary process continues to grow from strength to strength. I hope the proper constitutional process is being followed here. The most important thing is that the will is now there on the part of the Senate(and I would imagine other segments of the authorized constituted bodies) to do the right thing. Now all they have to do is follow the right procedures.

Fellow compatriots, what are we celebrating? The international govt must be laughing at us. Goodluck was recognised today as the acting president,so who is the acting VP? Nothing unusual has taken place! Rightfully, the deputy steps into his boss's shoe in his absense, that's what just happened and we re jumping and shouting. From the senate's declaration, that position remains available for Yar'adua anytime he comes back. Can't we see that this is simple politics. Otherwise why not the national compel mr president to issue the much talked about letter or consider impeachment. The FEC can also utilise its options. Let it be known to us that PDP's constitution(zoning policy) is more important to them than our country's constitution and democracy. Long live Nigeria

Good News but the Senate and the House of Rep should go a step further by setting up a committe comprises of 2members each from the 2houses and 2member each from the Army, Navy, Airforce and Police and 2member from NBarAssocciation,Civi Society, NUJ, EFCC and NLC to investigate the incident and the roles played by the president aidies, AG and any member of the FEC....Anybody found guilty of a cover-up should be punished, atleast, to serve as deterrant to others

Why are you rejoicing ? They are buying time. Jonathan himself knows that the resolution is illegal.The National Assembly can not order a take over. Yar Adua must transmit a letter to the National Assembly for any resolution to take effect . Now what the consistution has provided for is that if the President is not able to do that , then the Federal Executive Council can pass a decision declaring their 'leader' as incapable of discharging his duty!. Now that is the legal route. What the National Assembly has done is to remove pressure from teh FEC that is the only organ that can do a legal resolution . Dont you see it. It is all planned. Now we are all not talking about the FEC meeting again ! Common . People . Think !

Dear Dr. Jonathan, my advice to you: 1. Reshuffle your cabinet immediately and bring in strong loyalist technocrats 2. Sack Yayale Ahmed as SGF immediately and replace him, probably with the current Head of Service 3. Have your new cabinet declare that Yaradua is not well enough to continue his duties 4. On the strength of that you will move from acting President to President and c-in-c 5. Sack Farida and restore Ribadu to his job 6. Take it from there.

Too many questions.1. who is the new acting VP or is that post left vacant? So if a governor issues a statement to a foreign media it can be taken as an official communication? Are we so silly now? The fact that the senate says yardua is away on vacation and incapacitated means that the federal executive council should be tried for treason because they lied (and are still lying) and committed the conspiracy that yardua is still capable of ruling nigeria from behind the arabian curtain. These senators and house of rep members are a bunch of idiots? Why cant they just impeach yardua? Is he a god? I thought they said obsanjo should not rule indefinitely so yardua can rule even from the grave. Finally as a deltan I find it amusing and even irritating that some of this page are celebrating "a south south" president. There is no reason of that since it doesnt change the niger delta issues and it is an insult to think that the mere appointment of ONE man as president will assuage the anger from years of degradation in the delta!

I once mentioned on this forum that the President’s speech on BBC was a self declaration of his incapacitation and that there was no need waiting for a FEC resolution. The NASS just confirmed my view but ignored my advice on the next line of action. This Senate last week advised the President to transmit a letter without giving him an ultimatum as to when the letter should get to them. They wake up seven days after to pass a motion for the VP to act as President. Was this latest move a consequence of the President’s refusal to transmit the letter? Why the sudden change? What happens if the President goes on BBC first thing 2morow morning to say his doctors have discharged him? Mr. VP should be smart not to fall for this trap as his impeachment is imminent if he gives in to this.

But this is very awkward, how can the senate president say Yaradua’s purported speech on BBC is as good as a letter to the senate from Yaradua, why are these people bent on continuously fooling us? If Yaradua was “strong enough” to do that BBC voice over, why can’t he then write a letter to the national assembly? Looks to me like Turai is interested to see her husband die in power so he can get state burial. We should respect the law. This senate making Jonathan acting president is a compete wrong, Yaradua should resign, the man has overstayed his welcome. I applause the Nigeria Senate for finally passing a resolution on the lingering matter which had for sometime dominate the news.Though it come a bit delayed, it is the right step in the right direction. This shows that the political elite are not immune to the voice of the people...we should all note this. This is one step forward, but it will mean nothing if we all decide that the battle is done. What might seem illogical to us Nigerians is quite logical for those in power, oil rents mean everything to them and they will do everything to guard that at the expense of the nation. Let us not rejoyce. This is only a stay of execution. I am not a prophet of doom; however, let us look at the following points: Goodluck Jonathan will be worse than Yara'Adua. Is he not the one who said in an article in Sun newspaper that even if angels were to come and conduct elections in Nigeria that PDP will always win? This means more fraudulent elections come 2011. His hand-over by the senate did not follow the proper constitutional channel. This spells more and bitter challenges to the legality of his rulership. He does not seem to have the charisma. Let us hope he develops it on the job.

Birds of the same feather - Dora Akinyuli, Aandokaa, Yar'adua, Mark, Bankole, Aliero, Obasanjo... There is no hope for Nigeria - until we have a revolution and throw all these people out for good.. Right now, what we have is garbage, and as they say "garbage in, garbage out". Our "leaders" must send their children to public schools in Nigeria by law, must use hospitals in Nigeria by law, must live in their own homes, no more official quarters for lazy do-nothing legislators and ministers etc..

Well to me, it's a very fair judgement by the senate. At least let this boost our image a little for uprightness and many other factors that has taken us aback. This is a decision that would have taken immediate effect due to the normal constitutional process. But because we like twisting things around to satisfy our selfish interest; we ignore what ought to be done. Let us Nigerians practice fairness and uprightness and make it dwell deep within us to have a better Nation. Godspeed
