Bode George's conviction

Print print Email email Share Share

An Ikeja High Court in Lagos yesterday convicted Bode George, former chairman of the Nigerian Ports Authority, and five others on a 23-count charge of abuse of office. Mr. George was found guilty for disobedience of lawful orders and the awarding of contracts to the tune of about N100 billion.

Others convicted along with him were former managing director of the authority Aminu Dabo, Olugbenga Abidoye, Zanna Maideribe and Sule Aliyu, who were members of the board.

All were accused of flagrant abuse of office and the splitting of contracts to make it possible for the board to award for a total sum that was far above its authority to do. It took 15 months to arrive at yesterday’s judgment with the trial going through twists and turns and delay tactics on the part of the defence.

At a time the case was almost brought to a halt but justice though delayed was not to be denied. The fact that the case was finally adjudicated upon and the accused sentenced should be a lesson for public office holders, to know that they serve in trust for the people.

The conviction of George and the others may be the beginning of a return to sanity and a signal that there are those who will hold the Umaru Yar’Adua administration to its mantra of respect for the rule of law.

In passing his judgment, Justice Olubunmi Olugbade said, ‘‘When public office is abused, the entire populace is assaulted. This must not be condoned or treated with kid gloves. If the quality of service in our public life is to be altered to the appreciable standard of the civilised world, the right deterrent should be given.

"For the right deterrent to be served, therefore, sufficient firmness must be demonstrated’’ We are in agreement with Justice Olugbade. It is high time public officials are held accountable for their actions while in office.

It is because many of them have gone unpunished for such abuse that it continues to fester. Mr.George as a leading member of the ruling People’s Democratic Party, PDP, is not a modest man. He is flamboyant and his trial was almost turned into a circus by his coterie of supporters.

Apart from being a former deputy national chairman of the party, he was in the run up to the 2007 election the director general of the Yar’Adua-Jonathan Presidential Campaign Organisation.

By holding such sensitive posts and being a former military governor, he was by no means just an ordinary party member. His conviction should serve as a lesson to other public office holders: the abuse of office and peddling of influence do not in any way advance public good.

Apart from that, it should also serve to teach a lesson or two to those who appoint party members into positions of public office. They should be wary of the choices they make. Mr. George’s corrupt tenure at the ports has demonstrated the limit to which such patronage should be tolerated.

National agencies that exist to preserve and prosper the public interest should not be regarded as the personal property of politicians and businessmen who finagle their way into high office.

"Our primary agencies of government clearly need technocrats with the skill and the know how to work for public good. We trifle with our future when we allow corrupt individuals to loot at will.

THE DEFENSE THEY MOUNTED WAS CHILDISH...SAN OR NO SAN ...IF YOU WERE AWARE OF DIRECTIVES, EVEN IF SENT FROM ANOTHER AGENCY NOT TO DO SOMETHING, YOU CANNOT CONTINUE TO DO IT. EVEN IF YOU WERE NOT AWARE, IGNORANCE OF THE LAW IS NO EXCUSE....BUT TO EVEN STATE IN COURT THAT YOU WERE AWARE LATER, IN A CRIMINAL CASE IS A SURE FIRE WAY TO GET THROWN INTO JAIL...NEXT TIME HIRE AN AREA BOY TO LEAD YOUR APPEAL...THOSE SANS WOULD CLEAN YOU OUT BODE...

it high time d legislature make laws that sentences corrupt office with the death penalty or life in prisonment if really we are truthful to each other and want to build on this bode george cos jst two year can't amount for what he has illegally acquired 4rm dis nation. WE HV 2 STAND UP KNW COS THEIR IS NO BETA TYM.

Compared to the high stake corruption perpetrated by Chief Bode George,2years imprisonment is really nothing (more like tempering justice with too much of mercy). But I so much like the idea that his record will now tell us that the man is AN EX-CONVICT and that means a lot of damage to him politically. The judgment in my opinion should however allow for the confiscation of all material wealth acquired with the proceed of the corrupt act. I have no education as to whether the law allows for that or not. Anyone here knows?

Couldnt agree with you guys better. 2yrs in prison for steaaling billions betraying the trust of the nation? In China, he would face the firing squad on conviction cos he is no better than the armed robber, kidnaper or area who operates under the coersion of firearms. In this case, Bode George's weapons were his Military and Political powers under which he controlled hundreds of firearms. We also heard nothing of his ill gotten property being confisticated by the govt. as applies to convicts of his nature. Does is mean he is expected to serve his term and be released to enjoy his loot?... more questions again..

No not a relation of mine. Finally it looks like we still have some judges with integrity on the bench who will not tell us about misapplication, mismanagement, misinformation, etc. Five down and counting the number of EX-CONVICTS

I would like this justice train to also probe the presnt excutive directors of NPA because they stink of corruption. They all have foreign accounts and houses in UK which I can volunteer information if need be. Bode George used them also as his front I can confirm.

Are two year jail term the prize he will pay for billions stolen from the poor mass, the jobless graduates and the retirees without pension. EFCC should seize all that money and parade him naked along Alen Ave for slapping on the intelligence of Nigerians. Al-Mustapha should feed him with human faeces in Kiri-Kiri prison like they did to OBJ and probably when he comes out of jail, the mallams will make the president.

Steal billions of naira. Acquire choice income yeilding assets. Stroll to court in airconditioned cars wearing designer agbadas, get a sentence to restrict your movement to military hospitals (and a few owambe shows in Lagos and environs) and the government feeds you and pick your bills for two (prison calendar) years. Get a discharge paper thereafter and a clean bill of health and live in opulence and undisturbed ever after. I wish to enlist, please.

bode george was convicted not for stealing according to the court ruling but for contract splitting. let us not over-punish him above the judge:s ruling no matter the political atrocities of bode.

Posted by US_Yankee on Oct 28 2009

What's the point of sending him to jail without any restitution? Will he pay back what he stole? That's what I want to know. Nigerians need to start understanding that the money does not belong to the government, but to all Nigerians,it is our money, our children and grand-children money! Any government official that steals money has stolen from you and I, it's no different than armed robbery.

For me , there is still fear or favour in Bode George case. Is he not worse than Maddof in USA?They should have treated him the way Maddof was treated coz he is worser.

Posted by S L A on Oct 28 2009

Bode george conviction has really shown that we should be hopefull of good democratic rulling in the Country. There are still many of his like opressing the masses with their loots,EFCC should comb them out and bring them to book. Moreover, two year jail term is too small a detterent for such huge billion, death by hanging should have been okay. Mainwhile,Justice OLubunmi Olugbade, thanks for your courage.

Our people are very funny. They want to build their own Rome in a day. They do not believe that a journey of a thousand miles start with a step taken. To them a journey of a thousand miles start with 500 steps. Come off it and be realistic. When last was a major establishment sent to prison? When last was justice served in this dimension? Justice Oyewole made the point. He should be commended. Eni to se be ti o dun, e ni ki osa pa, eniti o se rara nko? 'the one who serve an unflavoured pot of stew, the gods were entreated to kill him, what about the one who did not cook a pot of stew at all. I have spoken. Chikena!

it is a studied judgment in technicality...he was hooked for splitting contracts against directives as against misappropriation of funds...hence the 2 year judgment...

Posted by Jj on Oct 28 2009

i think he got a slap on the wrist along with the rest of them for getting 2 1/2 years. but am glad we had them called out any many mmore of this will be done in the future. they should also be fined to pay back some of the money

That BG got a card to advance to jail straight is a vindication of the effort of the Nigerian media. He had taken a news magazine to court for defaming him! And OBJ was in charge then! That arrogance was a slap in the face of all of us but thanks to the judiciary and to the media for not relenting. Pls dont be discouraged until all the robbers masquerading as leaders book their spaces in Kirikiri.

GOOD,IT APPEARS THE JUDICIARY IS JUST WAKING UP FROM SLUMBER. THIS IS THE FIRST TIME IVE HEARD OF SUCH CONVICTION BECAUSE NO MATER WHAT YOU DO IN NIGERIA YOU WILL GET OUT FREE.UNTIL THE JUDICIARY SITS UP TO JAIL ALL WRONG DOERS EVERY THING WILL CONTINUE TO BE THE WAY THEY ARE.

These are the heartless and bad People in our nation, it was them that have retard the growth and the development of this great Nation, and they will live and still leave the bad characters to their generations yet unborn, and the Nation will remain developing country, I read that the devils a man's deed will live after their death, and their sin shall not be forgive in my Father name (God). And the Spirit and souls of those innocent that shed their for country will not forgive them and the children, Their sins will be ask form thier Children and Family, even the Generation yet unborn, Because they can't spend all the money during their life they are reserving it for their Children and unborn Generations.

I believe what had happened is the iota of the people expectations of what has happened in Nigeria and presently happening. I wish we continue in the spirit. On another note it is also imperative action that the property of these individuals who abuse public office be comprehensively investigated and seized. It will actually and actively discourage others not to venture on useless acquisition of public wealth they cannot hold their hands to. Let the music play on so that we salvage our country from decay.

This judgement is clear indication that there is nobody that is above the law no matter how highly placed in the society.

Posted by Mike Wisdom on Oct 29 2009

The judgement co-notes the ability of the judicial system to act when it matters most. Although they tried all their delay tacties but justice was for the people.Am happy that Bode George is now in prison cooling off his heels.

Posted by enobong on Oct 29 2009

George's conviction is a welcome development and can serve as a useful spring board to the rebranding process,if the judgment should become the rule rather than the exception. For there exists in the immediate past and present dispensation many more Bode George. All of them must be brought to book.

Posted by Aweni on Oct 29 2009

Just a point of correction. the judge's name is Olubunmi Oyewole and not Olugbade. I believe it will be unfair to incorrectly name a judge who is trying to ensure within his capacity, that Nigeria is corruption free. Meanwhile, let all evil doers desist, for they will surely be repaid one day. Bode George? Shame to your generations!

AS a lawyer, i never had doubt about the abliity of the nigerian judiciary. it is the policy of gov't that obstructs their hand. Now that the sword of justice has been unleashed, let it not spare any of these person found to have foulted the law. I salute the Jugde, Justice has indeed been handed down !!

ONE CANNOT HELP BUT JUBILATE THAT NIGERIA OF OUR DREAMS IS ACTUALLY COMING TO BE WITH A JUDGEMENT LIKE THIS. I DOFF MY HAT FOR THE JUDGE, I PRAY THAT FROM HIS GENERATION AND THOSE OF HIS CHILDREN'S CHILDREN YET UNBORN WILL SEE THIS NIGERIA. WHILE NOT GLOATING OVER CHIEF JUDGE'S MISFORTUNE, I MUST SAY THAT THE MESSAGE HAS INDEED BEEN SENT OUT, 'HOLD THAT OFFICE SACRED, HOLD IN TRUST AND NOT FOR THE SPOILS. GOD BLESS NIGERIA. WE ARE WAITING FOR THE NEXT SACRED COW TO TAKE UP HIS OR HER UNIFORM AT KIRIKIRI.

Why is it that these members of board of directors of Nigeria Ports Authority convicted by Justice Olugbade appear to come from the South West and the North ONLY? So much for Federal Character in Nigeria.

FINALLY, THE YAR'ADUA ADMINISTRATION IS MAKING A HEAD WAY IN THE RESPECT FOR THE RULE OF LAW. THIS SHOULD SERVE AS A LESSON FOR OTHER PUBLIC OFFICE HOLDERS WHO FEEL THEY CAN USE PUBLIC OFFICES TO ENRICH THEIR POCKETS. GOD WILL SURELY SEE US THROUGH.
