Soludo wants court to invalidate his suspension by INEC

An Anambra High Court has ruled against the Independent National Electoral Commission's (INEC) decision to remove the name of the former central bank governor, Chukuma Soludo, from the list of candidates for the Anambra State governorship election. The order came in late afternoon on Monday after INEC had officially announced the removal of the name of Mr. Soludo - the ruling Party's candidate in the forthcoming February 2010 election - following an ex-parte order from an Abuja High Court on Friday.

Justice Danladi Senchi of the Abuja Federal High Court had on Friday asked the electoral commission not to recognise Mr. Soludo as the party's flag bearer.This was in response to a motion filed by Okey Muo-Aroh, one of the 47 governorship aspirants of the Peoples Democratic Party (PDP) in Anambra State.

A petition instituted by two other aspirants, also from the PDP, Valetine Ozigboh and Victoria Nwakwo said to be allies of Chris Uba, had also asked the electoral commission to vacate Mr. Soludo's nomination as the PDP's candidate for the 2010 governorship election in Anambra State.

In reaction, Mr. Soludo immediately proceeded to the Anambra High court to challenge the decision.

The electoral commission is, however, abiding by that first order - based on which it removed Mr. Soludo's name, and "it is also headed to the Court of Appeal in Abuja on the morning of Tuesday, October 27, in a bid to vacate the order and resolve this impasse," said a media official who spoke under anonymity.

After court ruling in Anambra, the legal assistant to the Soludo campaign group and a former Speaker of the Anambra House of Assembly; Dom Obieke, told NEXT that "Mr. Soludo's lead counsel, Patrick Ikwueto, a Senior Advocate of Nigeria, is headed to the Abuja High Court to vacate the interim motion removing his client as the PDP candidate". "Mr. Ikwueto will be arguing that the Abuja court, which is the legal equivalent of a State High Court, has no jurisdiction over a federal agency like INEC," he said.

He also said that Mr. Ikwueto "will be arguing that the court cannot interfere in the process of selection of party candidates for elective office because there are judicial precedents from the Supreme Court on such matter." One of such precedence according to him, "is that of the April 27 2008 decision where the Supreme Court decided in Senator Hosiah Ehlawon vs. Olushola Oke (who is now the legal adviser of the PDP) that the judiciary cannot intervene in an intra-party dispute unless it violates the Electoral Act or any other law in Nigeria - calling to mind the Rivers governorship case of Chibuike Rotimi Amachi vs Celestine Omehia, where the PDP tried to substitute Mr. Amaechi's name after the deadline permitted by INEC and the Electoral Act." He said that Mr. Ikwueto will be arguing that, in this case, the Electoral Law was not violated.

The ruling party's move

The PDP leadership on its part has directed Chris Uba and his allies not to go ahead with a planned demonstration against Soludo's nomination today in the state capital. This was contained in a press release, dated October 26 and signed by the party's zonal secretary, Vin Okpalaeke. "We have been directed by the national working committee of our party to inform the general public... that the purported rally/meeting of our party scheduled to hold on Tuesday the 27th day of October 2009 at Awka has been suspended," read the release in part.

The party is also said to have, through its Vice National Chairman (South-East), Olisa Metuh, alerted the Inspector General of Police to take actions to stop the demonstration. However, there is no indication yet that the police has moved to stop the rally.

Mr. Soludo's camp had, last Saturday, organised its own rally in Awka, the Anambra State capital, with a crowd of about 10, 000 supporters. While opposition leaders fault the figures, those present at the rally include key party leaders as well as senior officials of the Peoples Progressive Alliance (PPA), led by its national chairman, Augustine Ndigwe, who pledged support for Mr. Soludo's candidacy. The PPA party headquarters in Awka has in fact been converted to the state headquarters of the Soludo governorship campaign.

Mr. Soludo's selection by the PDP has generated inter-party fracas among party members because the party did not hold a congress to elect the flag bearer, even though 45 candidates had paid non-refundable fee of N5 million to pick up nomination forms for the party's slot. Rather the National Working Committee of the party decided to appoint Mr. Soludo when the candidates failed to agree on a consensus candidate for the election.

About 70% of problems in Nigeria is caused by skimings and insincerity in PDP. They deliberatly creat security problems for security agencies and threaten their jobs if they don't get what they want. They want security without justice from the courts. Let us watch how only police can come in to settle their in house problems without the courts. IG, if you go in to their house, take them out to court for disturbing the peace. They should contain their fire in house to consume themselves, DON'T SPREAD IT.

As per the imposition of soludo as the concensus candidate of pdp is not a new thing; all pdp candidates winning election are for sales; so, soludo has bought pdp over and whoever can topple the bid should go to WADATA HOUSE ABUJA for the bidding.

Shakespeare said it long ago : PDP has murdered sleep so it shall sleep no more. I predict that there will be many more cases inb the future and they will jump from one court to the other til the Feb 2010 Anambra elections. And even if by some Naija wonder they are able to "capture" Anambra and install Soludo as Governor; rest will still not come the litigations will continue and we may even have another Rotimi Amaechi scenario in Anambra!! Meanwhile all this palaver would have been avoided by simply conducting a transparent election!!

The PDP is Nigeria's worst Nightmare. I can not believe that Charles Soludo will use this very medium to confirm his erroneous values. Evil thrives when good men do nothing. Soludo needs the immunity of a state Governor to stop the Court from jailing him when more criminal dealings about him would have been unearthed at the CBN. Which way Nigeria?

The Federal High Court gave a judgement; A State High Court gave a counter judgement. Isn't there the maxim of "Judicial Precedence" anymore? Or is the Federal High Court's judgement just an "Obiter dictum", which I know its not? Is the Federal Hight Court not a Superior Court of Records to the State High Court? Why on earth did the State High Court hear a case which has been adjudicated by a Federal High Court? Is it not a Superior Court of Records, in this case, the Appeal Court, that is supposed to adjudicate on matter like this? I need a Lawyer in the House to help me out.

It is sad that the evil spirit of God-Fatherism does not want to leave Anambra alone! Tufiakwa...... Without mincing words, I keep telling our people in Anambra to embrace SOLUDO now or perish! The PDP is unready, unwilling and quite possibly incapable of holding anything that resembles an election within its very own party. A party within which it should be possible to use influence and pressure to manoeuvre people even if the Head Office had a 'preferred' candidate. We can expect even less from them then when the Anambra election arrives. They will destroy everything. Election shams, violence, and corruption: they lead by example. Anambra 2010. Good luck!

Now lets put things in proper perspective. A PDP primary election was to be held in Anambra State. An injunction was granted by a Court preventing PDP from convening a State congress for the purpose of electing the Party's Gubernitorial Aspirant. The case was adjourned to a future date before which INEC's deadline for the submission of the names of Parties' representative would have lapsed. If PDP was to wait until the substantive hearing of the case, it would not have been able to field a Candidate for the elections. In order not to be disqualified, PDP decided to nominate one of the Aspirants as its Flag-bearer. This was how Prof. C.C Soludo was nominated in a nut-shell. All the Court cases are geared towards a single objective -to prevent election from being held in 2010 in order to pave the way for Andy Uba, who by the way parades himself as a Governor-in-waiting, to rule Anambra State. The Appeal Court is going to try to over-turn the decision of the Supreme Court in Uba's favour (Haram). While not trying to subscribe to ethnocentricity, I am of the opinion that the Ibo race needs to get its acts together. A situation where successive Nigerian Governments have been using the Ibos in Government to marginalize the Ibo race needs to stop. Too much emphasy on money needs to be discouraged. The Anambrarians rule Anambra. Yet the Centre has not been able to hold since the time of Mbadinuju. Bad govenance, poor infrastructure, kidnapping and othe deadly crimes rule the day in Anambra. In 1999, it was Mbadinuju vs Emeka Offor, 2003 was Ngige vs. Chris Uba, 2007 was Peter Obi vs. Etiaba with APGA on one hand and Andy Uba on the other hand - All Anambrarians and all looking for political offices for self-aggrandizement. The Onitsha-Enugu Express road has deep craters caused by erosion. Ascension from Upper Iweka Road to Onitsha-owerri road is an eye-sore. Staying out beyond 7.30pm is at your risk. Beyond politics, Anambra needs prayers!

I completely agree with Dare Taiwo's analysis of the current state of affairs in Anambra. The time has come for objectivity to come to fore and not the current outplay of mediocrity that subsists. In the interest of peace,wellbeing,sanity and respect for the Anambra people and the electral process of Nigeria,i wish the courts (whom duty now behoves) to adjucate clearly without fear,favour or partial concealment of the truth. For the sake of equity and the future of generations yet unborn..let this charade stop!..Nigeria needs to move forward and the time is now!!

I'm afraid the courts are playing into the hands of the PDP and its motley band of unscrupulous politicians. That famous banana peel appears to be lying under the table of the judges. When two courts at the same level of jurisdiction give two contradictory judgments, on in Abuja the other inside Anambra state, the impression you get is that someone has taken a bribe to pervert justice. It should equally be clear now that Iwuruwuru's INEC is working for Andy Uba. But lastly, why would a would acknowledged Professor of Economics allow himself to be messed around in this manner. Nigerians should henceforth beware of academics who abandon their gowns for full time involvement in politics. They are dangerous.

PDP is a fraud and we Anambrarians must never allow an election by selection again..Chris Uba, a secondary school drop-out and a nuisance can never hijack a great state like Anambra again....I pity a diplomat like Soludo whom they are using to get to thier ill goals again because, he will soon regret why he allowed himself to be messing up by evil men. PDP doesnt stand by it's name as People Democratic party but People Deceitful Party....

@Dare Taiwo, the roads you mentioned are federal roads. The federal government as usual decided to leave the roads in that deplorable state, besides the dearth of infrastructure you mentioned is a nationwide phenomenom as a result of bad leaders. The situation in a Anambra is a struggle against godfatherism which will pay off in the end. If Ngige had corporated with the godfathers he would have served his 8 year term and handed over to another stooge. It is worthy of celebration that Ngige resisted, unlike Ladoja in Oyo state who was thrown out by Adedibu and replaced with Akala.Obasanjo was so evil that he was actually the one sponsoring and supporting godfathers. At the end of the struggle godfathers will stay away from Anambrara state for good. As for your advice that too much emphasis should not be placed on money by Ibos, i say here that that stereotype is hypocritical and that advice should rather go to the Hausa and Yoruba people who have ruling nigeria since independence and have looted over $600 billion dollars and put nigeria on the map as the most corrupt country in the world. It is silly to peddle stereotypes that Ibos love money when the biggest money lovers that have looted nigeria dry have been from the North and West. Babangida, Abacha, Umaru Dikko, MKO Abiola, Abdulsalami Abubakar, Obasanjo etc etc how many of these bigtime looters are Ibos? An oldman like Bode George has just been convicted of looting 85 billion naira, is he Ibo? The appeal court judges that are willing to take bribe and make Andy Uba governor are all from the North and West. No Iboman has ruled nigeria, yet nigeria is the most corrupt country in the world due to looting by the ruling tribes from the North and West, and some fools will still be dwelling on stereotypes. If the other tribes dont love money as the stereotype suggests how come nigeria is the most corrupt country in the world under the leadership of the "money hating" Yoruba and Hausa? Go and check the list of the bigtime looters since independence who have looted billions of dollars and see where most of them come from. Go and buy Fela Anikulapo Kuti's music and hear the names of the bigtime looters. The recent elections in Ekiti state was as terrible as it comes. The problems of electoral fraud, manipulation and insecurity is nationwide. There is no part of nigeria were you can stay out at night and be safe.I would advise you to comment on issues in future without bringing in ethnicity or worn out stereotypes.

The poor masses are the ones suffering all these troubles from PDP and other parties creating chaos everywhere. People like Chris Uba and his croonies....the end time is near. Soludo, be careful. The problem with Nigeria is PDP...Until people stand up to say no to PDP, things will continue getting worse...We need a strong opposition, and that is what AC can give to Nigerians...If not, lets go back to a 2-party system (SDP & NRC)...That is the reason why it is the only time we had a free and fair election... Let us all support AC to take over Anambra and all other PDP states...
