Lawmakers want to be above the law

A Bill that may grant immunity to members of the National Assembly and state assemblies scaled through the second reading on Wednesday.

Titled: “A Bill for An Act to Amend the Legislative Houses, Powers and Privileges Act, Cap L12 2004, Laws of the Federation of Nigeria and for Other Related Purposes, 2009,” it was sponsored by Henry Dickson (PDP, Bayelsa).

Leading debate on the bill, Mr. Dickson, who is also the chairman of the House Committee on Justice, said there is need to propose a procedure that should be followed when a member commits a crime. According to him, by doing so, the lawmakers would be adequately protected and the country’s democracy deepened.

He said a lawmaker should not be arrested on the basis of a mere allegation, but that the security agencies making the arrest should only make such arrest when there is a warrant of arrest or if the person is caught committing the crime.

He added that such agencies should first communicate to the leadership of the House concerned before the lawmaker that commits the crime is arrested.

Honourable men and women

“If we accept that members of the legislative Houses are honourable men and women, therefore the need for extra measures should be taken in arresting such a person,” he said.

Nkeiruka Onyejiocha (PDP, Abia), who supported the Bill, said, if passed, it would encourage the rule of law and it would check a situation where people are whisked away by security agencies under different guises.

Betty Apiafi (PDP, Rivers), Joseph Idachaba (PDP, Kogi) and Bashiru Bolarimwa supported the Bill, emphasising that it would curtail the excesses of security agencies.

However, Ita Enang (PDP, Akwa Ibom), who opposed the Bill, said it would place legislators above the law.

Mr. Enang, who is the chairman of the House Committee on Rules and Business, warned his colleagues that passing the bill into law would mean an extension of the immunity clause to members of the legislature. He said Nigerians are already averse to the issue of immunity for their leaders.

Emmanuel Deeyah (PDP, Rivers) also opposed the bill on the ground that what the Bill seeks to achieve has been covered by the Standing Rules of the House.

Members, however, voted for the Bill to be read for the second time when the deputy speaker, Usman Nafada who presided over the plenary session, put it to vote.

Mr. Nafada then committed it to the Committees on Judiciary and Human Rights for further legislative action.

Difficult to arrest and prosecute

If eventually passed, the Bill may make it difficult for security agencies to arrest senators, members of the House of Representatives and 36 state Houses of Assembly members.

Some members of the National Assembly have, in the recent past, been arrested over alleged fraud.

They include the former chairman of the House Committee on Power, Ndudi Elumelu; his Senate counterpart, Nicholas Ugbane and the House chairman of the committee on Rural Development, Igwe Paulinus, over their alleged involvement in N5.2 billion Rural Electrification Agency fraud. Mr. Elumelu’s deputy, Mohammed Jibo, was also arrested over the allegation.

The immunity clause, as spelt out in Section 308 of the 1999 Constitution, only covers the offices of the President, Vice President, Governors and Deputy Governors.

Bills and more Bills

The Bill’s sponsor also said that voting on the floor of the House should henceforth be recorded so that Nigerians can know how their representatives vote. He noted that, if this is done, the vote of each lawmaker would count when decisions are taken.

Also, “A Bill for An Act to Establish the Institute of Mediators and Conciliators and for Other Related Matters, 2009,” and “A Bill for An Act to Facilitate Electronic Transaction in Nigeria and for Related Matters, 2009,” also scaled through the second reading.

Before the House commenced debate on the bills, members had dissolved into an executive session, which lasted for about one hour.

A source told NEXT that the leadership of the House briefed members on some issues which arose during the two month recess.

Among the issues reportedly discussed at the executive session were the welfare for members, the review of the constitution and committee placement.

Onthe day Italian PM immunity was removed.....Nigerian Lawmakers are spending our resources to protect themselves against crimes they have committed or will commit come nxt election...like murdering their opposition.........what a misplaced priority!

This is a great news. The shit bag who sponsored this bill has apparently realised that he and others in his criminal gang may soon be arrested and hauled off to prisons for crimes against Nigerians. This is a fruitless attempt to forestall the inevitable. At this point, it is fair to say that there is no single honest person in the Nigerian legislature. It is also fair to suggest that many of them sill fail well-designed psychiatric evaluation. If Mrs. Waziri of EFCC has anything to offer Nigeria, it is to push that these catoon characters who masquerade as legislators under psychiatric test for fitness in office. I hope I am wrong. Let's see who among them will vote against this anti-democratic bill.

The SPONSOR of the bill (Henry Dickson (PDP, Bayelsa), definitely has skeletons in his cupboard or as pointed out by 'Green9ja' are spending our resources to protect themselves against crimes they have committed or will commit come next election...like murdering their opposition!!! untill the immunity clause protecting the president and state governors is removed the problem wont be solved.when the president and state governors loot the treasure of the nation or their states they are free to move about.the case of ibori is an example.nigerians should agitate for the removal of the immunity clause entirely from the constitution. The Freedom of Information Bill is in the cooler, the electoral reform bill is dancing ajasco between the senate and the house of reps. These notwithstanding, a dim witted buffoon has presented a bill to enhance their status. Is it not about time Nigerians are mobilized to take back their country come 2011?

I cant believe what Ive just read! What manner of people are these? I mean the sponsors of this toxic waste of a bill. What is the anticedent of this "disHonourable" Henry Dickson? Clearly instead of addressing ways to enhance the work of security agencies or even "curtail" the excesses of security agencies against members of the public they claim to be representing they would rather have immunity. If security agencies arrest others without proper investigation shouldn't that be what they should be addressing holistically instead of this charade. Never mind they want immunity against the next round of rigging. May all thos who support this bill never see thje hallowed chambers of the National Assembly after the next "selection"

When the House of Reps vigorously fought to remove Ete as Speaker, and wily nilly replaced her with horse-teeth Bankole, we had imagined that for once, there will be purposeful leadership in the house. What we see today is a collective shame on Nigerians. What is grossly missing is a charismatic revolutionary that will rouse the mass of Nigerians from this lethargy and somnolent trance. In all the woes of our country today, in all the hues and cries, where is our National Assembly? It is obvious that something has to give somewhere. The country is over ripe for a revolution. Caution should be the watchword for our legislators. If they are true to the tittle and really have the interest of democracy at heart,they should know that such bills of immunity would rather cause distractions: they will begin to see themselves as "lords" and "untouchable." I'm disappointed in the member representing my State (Nkeiruka Onyejiocha, PDP, Abia). This shows that she is selfish and dosn't understand what it takes to be an honorable member of the house of representatives. when other countries are removing immunity from their Presidents (like the case of Italy), Nigerian lawmakers are here talking of how to protect themselves if they commit crime. @ 49 we still have educated illiterate lawmakers. It is a pity Nigeria.

Extra measures should be taken before arresting any person i.e. the agencies are expected to build a prima facie case before arresting people not merely on the basis of petitions that are yet to be substantiated. In most progressive countries, the agencies build a solid case before arresting people not arresting before investigation as we do in Nigeria. The bill should be directed at dealing with these issues for everybody not only rhe NASS members.

Another good idea would be legislating permanent seats for each memeber in the House and Senate plus an automatic right of your first born children outside wedlock to take over if you become indisposed. The lawmakers once said it would be time consuming to engage on debates to resolve the resource control palaver as well as dismantle the inequity (arising from the five states structure) imposed on the Southeast in their constitution amendment exercise. Tackling the two issues would have gone a long way in resolving Nigeria's political problems. But now the lawmakers are wasting the tax-payers money talking about acquiring unconstitutional and undeserved immunity. This is scandalous.

I thought the so-called Nigerian Law makers or thieves would have passed a bill for free education or stoppage of strikes or even for PHCN to stop taking light in the country rather than bills for immunity incase they stole from the country's treasury.(which I am sure that is the reason for this bill) It is sad that in a country like Nigeria who just finished the Just concluded NBA for the west african countries in Lagos will just fold hands and let this things happen to its citizens. I was hoping the so-called lawmakers would wake up one day and pass a bill stoping the use of sirens and escort by the foreign citizens claiming to be expartriate who end up buying water for domestic use in most of our companies in this country. It is really sad that our legislators can be so shameless and insensitive to the challenges facing us as a country. I dont blame them. Apart from very few people likes Mr. Ita Enang of Akwa Ibom and the like, most of the other legislators are men and women that have nothing good to offer this country. Guys I think it's time we start to let this people know how will feel about thier selfishness. This guy has probably been involved in sponsoring terrorism in the Niger delta under the name of militancy and now that the amnesty is taking baby steps towards success he is afraid his dirty laundry will soon be made public. So right now he is trying to find a law to protect himself. I hereby propose that one million regular letters are sent to the national assembly stating we stand against this bill. Hopefully by the time floor of the floor of the house is filled with papers, the desire of the Nigerian people will be adhered to. So buy a stamp today, send a letter to the speaker of the house, mark the envelope with "NO TO IMMUNITY" and tell someone to do the same. Remember the target is one million letters.!!!!!!!

We already have the most expensive legislators in the whole world now they want an immunity clause to cover them from the law.This is shameful where then is the EQUALITY under the law. I hope Mr Bankole and his co-travellers realise the implications of such a move.Here in the UK where Mr Bankole was trained members of Paliament are been probed for claiming some of basic necessities.Meanwhile in Nigeria, you claim almost ANYTHING, inflate contracts and now you do want to face the law. This is why Kidnapping might thrive better in our enviroment.

When will our legislators stop acting like illiterates. If they are clean why would they want to protect themselves. This is one of the thing that makes me weep for my country and also prepares the ground for the revolution that is coming. To the greedy politicians, keep stealing, keep pertetuating your evil deeds, mind you a revolution is soon approaching that would sweep all of you out of the positions you are holding. This is not a threat but a reality. To my fellow Nigerians that are fed up with these dirty politicians lets keep praying for for the change to happen fast and never lose faith in our dear country. What we need is for the rule of law to work. There is so much corruption that a majority have made it a way of life; including most politicians and religious leaders. We have politicians who are proposing laws to immune them from arrest relative to criminal investigation that may implicate them. Our people are very resilient and enterprising but law enforcement agencies need to uniformly enforce the law so that we can function, at least with a "sense"of security. Furthermore, basic infrastructure (decent roads, steady electric power supply, a modern railroad system across the country, etc) must be in place for the country to thrive and attract a global admiration that is deserving.
