EFCC arrests Arik Air’s chief pilot

Operatives of the Economic and Financial Crimes Commission (EFCC), on Tuesday, visited Arik Air’s headquarters in Lagos, halted administrative activities, and arrested the airline’s chief pilot, Victor Egonu.

According to the airline, the EFCC’s visit was on the grounds that the airline is irregular in its tax payments.

The media representative for Arik, Banji Ola, confirmed the arrest. “The anti-graft agency personnel have since left, but have taken away our chief pilot, Captain Victor Egonu,” he said.

He further disclosed that the carrier’s normal operations were affected.

An effort to get the EFCC spokesperson, Femi Babafemi, to comment on the incident was not successful, as his phone was busy at press time.

Arik Air has been in the news lately for its decision to protest the handover of the General Aviation Terminal (GAT) to Bi-Courtney Aviation Services Limited.

The airline accused Bi-Courtney of wanting to impose a monopoly on the sector, saying the matter was being challenged in court, and all parties were expected to stay action until it was resolved, threatening to halt its services if the federal government failed to reverse the planned handover.

Employees of various aviation unions took to the streets in protest, and the senate aviation committee moved to suspend the action. However, the terminal was handed over by the aviation at about 6.30pm on Saturday, September 19.

Bi-Courtney, on its part, insists that its concession agreement with the federal government gives it rights over all domestic flights in Lagos. “Exclusivity is a feature of any concession contract and not private monopoly. Exclusivity is one of the safeguard to ensure returns for the concessionaire,” it said.

Upon the handover, Arik’s acting managing director, Chris Ndulue, backtracked on the original threat to halt operations, saying the airline had a duty of care to its passengers.

Why am I not surprised? Possibly because I am fast joining the rest of Nigerians in being scandal fatigued. EFCC pursuing irregular tax payment, possibly FIRS pursuing corruption and embezzlement-Who knows? Nigeria Bar Association conducting drug efficacy tests while Nigeria Medical Association probes collapsed buildings. I am getting tired.

OH boy. What a country. These lunatics in security uniforms are absolutely crazy. EFCC is certainly not a debt collection agency. Instead of spending their time and energy prosecuting the likes of Ibori, Kalu and all those other governors or even preparing their cases against the bank chiefs who looted their banks, they are hounding businessmen. Why on earth if they did not see the chairman of Arik should they start arresting other employees? Tax irregularities? We are certainly going down a very steep hill as a country.

Hey, c'mon guys..! Tax Evasion is CERTAINLY an Economic & Financial Crime and therefore falls within the jurisdiction of EFCC!! I am not concluding that Arik Air is guilty yet though.

It is not clear whether tax evasion-related offenses fall under the responsibility of the EFCC. It is clear, however, that the establishment including the EFCC have turned a blind eye to the MAIN culprits in this country. The likes of Odili, Ibori, and other serial looters who steal unhindered and unashamed, with the cover of the very same people who sit in Abuja.

Some one should please tell Farida Waziri that it is not the duty of EFCC to go after tax offenders, besides on what grounds is the Chief pilot being arrested maybe the tax comes from his pockets. Well, this is probably a way of EFCC leader and her officials replenishing their pockets. Is it a game they are playing along with tax officials or decided to change their job description? These people cannot be trusted. Leave ARIK alone and do not frustrate the business, afterall what became of Nigerian Airways. Anyway sa, Xmas is fast approaching, they need money to lavish for their selfish needs. I know that this a bid to engage in another corruption/embezzlement. Some people are just out to ridicule Nigeria more and more that you think do they deserve to be in power. God help us in Nigeria.

To TATA and all others above that have expressed an opinion similar to TATA's: EFCC has not turned itself into the Federal tax collector. It merely seems to be investigating tax evasion (a financial crime) which it is statutorily empowered to do. If EFCC's investigation in this regard stemmed from a complaint to EFCC by the FIRS itself (as the FIRS does not have it's own armed enforcement unit and may, if it so desires call on either the police or the EFCC for additional legal muscle) then EFCC may well have done nothing improper here.

To TATA above and all other commentators with views similar to TATA's: EFCC appears to be investigating tax evasion (a financial crime) which EFCC is empowered to investigate and prosecute. It is entirely possible that FIRS may have reported the matter to EFCC in order to obtain additional legal muscle since FIRS does not have its own armed enforcement unit. If this is the case then EFCC's motive may not be as questionable as it may have seemed on first glance.

Com'on you should know better. Tax evasion (posting ficticious exp, reduced revenue, etc) - using criminal methods to reduce tax payable - is an EFCC concern. Not paying tax (FIRS duty) is not same as presenting fake financial statements in order to reduce tax liability (EFCC duty).

The pedestrain level to which we reduce issues is alarming. Some one should go see section 46 of the EFCC Act which defines tax evasion as an economic crime. We must as a country learn to be objective and knowleageble about issues before commenting.

This is long over due. This man is bigger than Ibori as a crook. If the EFCC wants to do their work properly, please bring out the so called power probe report. Also, investigate River state finances and illegal oil exportation in Niger Delta. This is were the startup funds came in for Ojemai Farms Ltd, Arik Air and Rockson Engineering and bribing of bank officials to get cheap loans without collateral. The guy and his wife are the biggest fraudsters in Nigeria. They dey parade as if we do not know them. It is a pity that some of us do not say or write the truth. EFCC was set up to track fraudsters and bring such people to justice. If Arik has done anything wrong which is within the law that set up EFCC so be it. At the same vein, if it is just tax evasion this must be left for the inland revenue to deal with. This whole issue stinks...Arik has been doing a good job for air travellers so Babalakin must not use his connection to distrupt this..beware as others are watching to bring you down.

Na wah for EFCC. Is it becasue they called out the embarassment of a Minister of Justice? Or perhaps Babalakin sent EFCC after Arik? Why arrest the Chief pilot, becasue the company he works for is suspected of irregular tax payments? When was the first notice sent to Arik about this matter? Does EFCC even know what the so called regular tax payments are supposed to be? What a shame, tomorrow the president (lets not even start with him on his Saudi trip) will claim he wants Nigeria to have a robust homegrown airline, look at what they did to the two biggest players, Virgin, and now Arik. if Arik air has done something wrong n if its under the jurisdiction of EFCC, then EFCC has the right to persecute them. i believe most of this companies evade tax cos the government is not providing what we pay for.....naija is a country where there is double taxing; u pay tax to have light; u dont get the light n PHCN stll brings bills n u need to run ur gen still PHCN is a stand-by source of power...so u r paying twice for something. I thank God for nigeria n May HE forgive us of our sins....but things are definately going to get better in NIgeria
