AC condemns senate resolution

The Action Congress (AC), one of Nigeria's main opposition parties, has described the recent resolutions passed by the Senate and the House of Representatives as illegal. The party said in a statement by its National Publicity Secretary, Lai Mohammed, that ``Section 145 of the Constitution is very clear on how a Vice President can act as President.

The Senate cannot empower the VP to act as President by resolution. What has happened today has taken Nigeria closer to the abyss, instead of bringing it back from the brink. All hell has broken loose.''

While advising the Federal Executive Council to evoke section 144 of the constitution and "immediately declare the President incapacitated and inform the National Assembly to set up a medical panel pursuant to that declaration," the party advised Mr. Jonathan saying "Vice President Jonathan should take wise counsel and keep to the law. He should see this Senate resolution as nothing but a Greek Gift designed to do him in."

my brodas Lai is very correct. I have checked the constitution and there is nowhere that it empowers national assembly to give Nigeria an acting president by a resolution. We have procedures and it should be followed and that is simply the suggestion of Lai and AC. Mind you, Lai is not suggesting that they shouldn't hand over to Goodluck, but he is suggesting that the rules should be followed. As for me, Goodluck will lose his credibility if he accepts this resolution and acts upon it. Lets not condone lawlessness in Nigeria because of the situation. We should be calling them to order. In fact lai spoke my mind. immediately I read about the resolution this afternoon, I questioned the legality behind this action and of course Lai a lawyer has confirmed its wrong. There is only one procedure to have an acting President and that is through a letter by the President to the national assembly that he is proceeding on vacation. The other ways are procedures of making the VP president. which is by FEC declaring him incapacitated or by national assembly impeaching the President which automatically makes him the President. Anything aside from this is lawlessness.

Nicholas Emeka, where was lai when the charade called election in Anambra was upheld? Or does Nigerian constitution now stipulates that election should be awarded based on last honor? Lai and his AC has no moral justification to pontificate at this time. A resolution has been passed and the best we can do now is to find smooth landing for those who never believed an Ijaw man can be president in Nigeria. @Mohammed N'Allah, Zamfara, Jesus Christ, Our Lord, shall heal you, your Sultan of Sokoto and your fellow people in the North, in Jesus Name, Amen!

iDumu Dian of course AC has stated their ground. Lai said on head to head in Silva bird tv that AC was going to hold a meeting to determine the next line of action. Mind you, Anambra election was not rigged by APGA but INEC massively disenfranchised voters which also cut across party line. If AC will be taking anyone to court, it will be INEC for not presenting better voters register and also for ignoring court ruling that INEC lack the right composition to conduct elections. I am very much in support that power should be handed over to Goodluck but not by crook. There is a process and that process must be complied with. We cannot condone this act of unconstitutionality by the National Assembly and PDP govt. Of course, Lai has indicated severally that he wants power to be transferred to VP but it doesn't stop him from criticizing the actions of the Senate which is unconstitutional. Goodluck must come to power clean. I promise you that there will be immediate court action against the A. president. As for Mohammed N'Allah, Zamfara, he is a cattle rancher who doesn't know what federalism, democracy is. I am not in anyway supporting his view.

unpopular as it may sound Lai mohammed is correct. The senate resolution is an extension of the national assembly's continuing unwillingness to abide by the constitution. Any thing Jonathan does under this illegal resolution is under the law null and void and of no relevance. The resolution actually tries to preserve the existing state of interregnum until the yet incapacitated yar adua is able to write a letter claiming to be well and able to discharge his responsibilities. The question we should be asking is WHY CAN WE NOT DO WHAT THE CONSTITUTION EXPLICITLY STATES or even Impeach this president that has been AWOL for almost 90 days.

people, what this does is to set a very dangerous precedence. if a state assembly is not happy with their governor (for whatever reason), they can point at this and ask the deputy to take over. what ac is asking is that it should be done constitutionally. the only people who can declare yara-slow incapable of office is the FEC. and since most of them are yes-men, you cant get any results from them. so right now, i dont know whether to be happy or anxious because, mark my words, the repercussions of this action will have multiple effect.

I agree with you countryman, Mohammed from Zamfara has spoken the mind of an average northerners. I think is high time we call a spade a spade with the northerners. They just want to hold onto power and continue to reap bountifully where they sow little. Its a matter of time " Akeregbe me juwe ibi ti won ti okun bo ni ara re". Jonathan has been declared legally or no illegally as acting president. This will mark the beginning of chapter two of this scenario.

Congratulations Mr. President Goodluck name has effect in human life from Deputy Governor to Governor and VP to President it is good to follow the ways of the Lord. At the same time the constitution stated it clearly in section 145 of the Constitution so be wise and any other person eventually if it happens will still wait for the resolution of the Assembly which is wrong as Lai Mohammed said. So that it will not be like a "Greek Gift". ASK FOR GOD'S INTERVENTION AND BE WISE MORE THAN SOLOMON! Well the Lord has done in His way. CONGRATULATIONS MR PRESIDENT.
