Reps back senate on Goodluck takeover

Hours after the Nigerian senate passed a resolution asking the Vice President, Goodluck Jonatahn to assume the status of the nation's Acting President, members of the House of Representatives also Tuesday voted in like manner.

The Representatives came to the conclusion after two tension filled executive sessions, during which the house could not agree on the motion.

The passage of the two motions comes after almost three months after Nigeria's president, Umaru Yar'Adua.

A Lagos lawyer, Bamidele Aturu who is one of the lawyers asking that Mr Jonathan be made acting president described the action of the Nation as a decision based on expediency rather than legality. He also said the decision was as a result of the ‘act of negligence' by the Executive Council of the Federation.

Motions do not generally possess compelling power. It's like the bark of a toothless dog? If they really want to save the nation from the political abyss it's journeying into, let them amend the constitution or better still, impeach the president!

Thank God they have now found the spine to do what should have been done two months ago. It is a victory to all those who had the courage to condemn openly what obviously was a blatant disregard to rule of law. It tells us a story; that each time we rise up to insist on what is right, we shall have it! Let them send the text of the resolution to Mr Jonathan for immediate implementation.

JONATHAN SHOULD BE CAREFUL WITH THESE POWER HUNGRY PEOPLE. THEY ARE NOT HONEST. I SUSPECT THEY ARE SCHEMING FOR SOMETHING. THEY WILL BE HAPPY IF YOU COMMIT ONE MISTAKE OR THE OTHER. THEY ARE NOT HAPPY CEDE POWER. THAT IS THE PHRASE THEY OWN NIGERIA; OTHERS ARE STRANGERS AND VISITORS. THEY ARE PLOTTING. SINCE NOVEMBER NON OF THEM HAVE ENJOYED DEEP SLEEP. Is there any option? I think what happened is that the blood suckers have exhausted their tricks. What is the big deal, if these people are really serving the nation, they should have installed the VP immediately the President became incapable of performing his duty.

this is a coup against the constitution...didn't the fec also hear the same bbc interview, why has the fec NOT taken action based on that interview, and the fact that they have NOT seen the president in 76 days...a coup by any other name is still a coup...and history teaches that after the first coup...there is always a counter coup...

What both houses have done has no constitutional basis. The only constitutional way to resolve this impasse is to get the president to transmit a letter. If that cannot be done he should be impeached. I see legal battles ahead. Mr. Goodluck, you are starting on shaky ground.

Half bread is better than none. So, in my view, political expediency is beter than not taking any action at all while the ship of government continues to sink. What the senate has to do now is amend the constitution to plug the hole and avoid a repeat of such callousness displayed by Yar' Adua. Let him come back at any time and summon the temerity to challenge the resolutions of the senate and the house for transfering power in acting capacity to Jonathan. He would not claim to beter than Mobutu, if he ever does.

The National Assembly action is in order. S.145 says ' ..transmit a written declaration', not a '..transmit a written letter'. Mr Ya'Adua made a verbal declaration and was transmitted both in 'audio and written ' forms by the media, and the Senate President and the Speaker have both acknowledged the receipt of the 'transmission'. So what else is the issue. The doctrine of neccesity has also help in curing any perceived inadequacy. I challenge any one to test this action in court. This is a victory for our democracy and the resilience of our people. So Jonathan has no choice in this matter.

Garba AA you are one of those people disrecting the constitution of nigeria in pursuit of selfish gains like all the SOBs in our parliament. S. 145 provides that: "whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office until he transmits to them a written document to the contrary, such functions shall be charged by the Vice President as Acting President. Doesnt this presupposes that the document must be signed by Yar'adua or have we started adopting bio-metrics elements such as voice, eye and finger prints in supporting the genuineness of something as constitutional important as a written document. Jonathan, these guys are all serpents in sheep clothings. Test your powers by first sacking AGF and lets see the ripples the action will cause in our polity. May God keep you wiser than Solomon Jonathan.

@Garba AA, they say ignorance is bliss. But it is foolish. Why will you tar a road so that you can walk on grass? The constitution makes full provision for the these unforseeables, but PDP either cannot read or will not read.

Some people are talking now about constitutional basis as if Yar'Adua and his chief legal officer, Aaodankaa, have always conducted themselves in line with the provisions of the constitution. The issue here is that Yar'Adua violated the constitution by refusing to transmit a letter informing about his medical vacation and transferring power in acting capacity to Jonathan. Who says that illegality cannot be answered with "illegality", if anyone should as such refer to the resolutions by the senate and house, to correct and enforce what by the constitution Yar'Adua should have done in the first place before embarking on a medical leave.

Strongly peaking, if Good luck does not sack people like Mike Aondokaa, and ojo maduekwe, he is digging his own grave with his eyes wide open. A lot of work has to be done on the security detailes in the country, because the NORTH, BELIEVE THAT NIGERIA BELONGS TO THE HAUSA'S AND THE NORTH AS A WHOLE. GOODLUCK AND OTHER TRIBES ARE SEEN AS MEER MESSENGERS AND STRANGERS TO NIGERIA.
