After 78 days of political paralysis, a solution to the lingering controversy over the power vacuum in the presidency is likely today as the Senate discuss the process of transferring powers to Vice President Goodluck Jonathan.

Today, in our nation’s capital, Abuja, the Senators will meet to decide on what to do to lift Nigeria out of the political debacle that President Umaru Yar’Adua’s absence has thrown the country into.

The Senate reconvenes to vote on a motion that would empower Mr. Jonathan to act as the president nearly three months after Mr. Yar’Adua left the country for medical treatment in Saudi Arabia. Today’s session comes a week after the leaders of the Peoples Democratic Party (PDP) urged the senators to suspend their agitation to enable the party resolve the controversy within seven days, which expires today.

Last week, state governors who took the unprecedented step of calling Mr. Jonathan ‘Acting President’ said they would be visiting the National Assembly to urge the lawmakers to accept the court verdict which granted the Vice President powers to act in the President’s absence.

NEXT learnt that the Senate is eager to give the impression of transparency and the Senate President, David Mark, has therefore invited the Nigeria Television Authority to give live coverage to the debate and the governors’ visit.

Labour also threatens

Also unions affiliated to the Nigerian Labour Congress (NLC) will be meeting to declare their stance on Mr. Yar’Adua’s absence, later in the week.

“The NLC cannot just make a decision without following due process as the body comprises of many union members,” said Denja Yaqub, its assistant general secretary in a telephone interview.

“That does not mean we do not have a stance on the issue but in our own case, having a position among the members is not an individualist one since we are a standardised organisation with different organs, councils and committees which have to meet before making any collective decision.”

Mr. Yaqub was responding to the accusation that labour had left it too late before reacting.

Outcome of negotiations

According to a party official, the motion in the Senate was the outcome of week-long negotiations between many interest groups which included PDP members, governors, and lawmakers - wherever they stand on the issue of power transfer to Mr. Jonathan.

“We asked for time believing the party can get everyone to act properly in the interest of the peace and the party,” the PDP official said.

The motion which is scripted in the manner in which the state governors have lobbied is expected to receive the vote of the majority of the Senators. The governors are expected to witness the voting process which they hope will validate their one week effort to find a political solution to the crisis.

Lawyers however fear that having Mr. Jonathan become acting president through such a process, may bring him and the decision under intense legal scrutiny. They point to the fact that such a motion by lawmakers is usually no more than a piece of advice and bears no compulsion of compliance.

“I think the resolution alone cannot do that,” said Bon Nwakama, a lawyer.

“The Senate did the right thing by asking for the letter. If the letter failed to come, they can move against the president as disobedience and can impeach him,”

Mr. Nwakama, a Senior Advocate of Nigeria, said the decision “will be very debatable because it lacks the force of law.”

Senators do not, as a rule discuss these issues openly. In the last few days, the lawmakers have become more secretive and refuse to discuss the chamber’s possible approach to the matter especially as it concerns the extra-legal questions that may arise.

The Senators say they fear discussing the plans will “pre-empt” today’s attempt at arresting the constitutional drift that has gone on for almost three months now.

“Let’s all wait and see, there is nothing to talk about for now,” a senator believed to be in support of the decision to override Mr. Yar’adua, said in an interview yesterday.

The senators and all persons, who are charged with the duty of administering Nigeria must realize that the unity of Nigeria is a product of a contract, which terms and conditions are expressly embodied in the constitution. It follows therefore that if the constitution is discarded, then, the country shall have no other option than to disintegrate, and the self made leaders must have themselves to blame. Nigerians have tolerated for a very long time now, and have almost been pushed to the wall; we should therefore not take responsibility for any eventual disintegration of Nigeria, hence, the earlier the legislators act, the better for the country.

This Yar'Adua,Saraki,David Mark,Bankole etc nonsense has gone far too long that a more forceful approach is needed.Let it be known that the so called Governor's Forum has no force of law behind it.It is the weapon fashioned by Saraki,Uzor Kalu,Ibori and their thieving colleagues to flaunt their illegal power over the rest of us.It is a gathering of election riggers where they go to compare notes on the 'progress'of looting in their states.It was used as a platform to 'intimidate'OBJ to make concessions to Atiku leading to the laundering of over $40m in the US.The shortest route to dumping Yar'Adua for 78days AWOL is IMPEACHMENT.The trip to Saudi Arabia is an attempt to divert attention and further delay the process.It is also a waste of our common resources.

Yes, it is submitted that the act of impeachment is an imputation of having committed a crime- you may wish to softly refer to such an act as 'gross misconduct'. But, the fact is that since our lovely cake sharing democracy came onboard, to my knowledge, not even one resolution passed by any chamber of thf national assembly was ever obeyed or implemented; a recent case which suggests the non binding nature of a resolution was the me passed ordering the FCT minister to remove the very expensive speed bumbs littering the roads of the fct and damaging their cars. The minister simply ignored them an instead built more. Now, see the dementia infected governors and the business tycoons in the national assembly, hear what they are trading! The very known ineffective method. If it couldnt compel a single minister to act, what foolishness makes them think that it will resolve a constitutional crisis? These politicians are fully aware of their schemes and they think we are all fools. We need people that can read and understand what they read in positions of governance-especially in the parliament. Please do the right thing as prescribed by our constitution and forget about what your imagination says.

Someone explain to me what authority the senate and governors forum have under the constitution other than impeachment. If the reports are accurate that he is medically incapacitated only the FEC has the constitutional authority to declare him as such and then proceed to the national assembly. I dont understand what the senate will do today

The game indeed is up for the pro-yar'dua group.The hand-writing is already on the wall for a Jonathan presidency.However, the resolution to receive communication from Goodluck by the senate, as positive as it appears has no force of law; hence the need for a resolution by the FEC or a letter from Mr. President about his medical vacation, paving the way for the National assembly to install Goodluck as acting president, pending when Yar'dua returns. Now, as well-meaning Nigerians, we need to pay rapt attention to the events that are about to unfold this week and the coming week or else these politicians that are bent on maintaining the status quo will take advantage of the gullibility of majority of Nigerians regarding what the constitution clearly states on this matter. God save Nigeria!!!

This is the wisest - most commonsensical comment here in a long time. I am even upset that our beloved NEXT cannot point out that no Senate resolution can provide constituional/legal backing for the VP to become Acting President. Africans! Black Man! They always dissappoint. Lest I forget, there is another option. An emergency amendmnet to the Constituion - allowing for the VP to AUTOMATICALLY become ActIng President if the president is absent for more than 14 days.

Turai and her small number of acolytes that have held us to ransome for so long are not constitutional either. We do not know for certain where, or the condition in which, the President is. This is not the time for further upheaval, CountryMan. You know very well that the two roads of impeachment and Executive Council removal are littered with further opportunities for Turai's rearguard to dissemble and delay. For instance, who will go and bring the personal physician of the President back from Saudi Arabia? Or how will you muster two-thirds of BOTH Senate and House of Reps to impeach the President. If the Senate passes that resolution, the only person whose rights would have been infringed upon is President Umar Musa Yar'Adua. No-one else has a legal basis to go to court. AFTER Goodluck Jonathan assumes the title and authority of "Acting President", I'll be happy to join you in arguing back and forth about the constitutionality of such an assumption of office, while we wait for President Yar'Adua to sue the Senate and his Vice- President. For me, the clear will of the majority in whose name the Constitution purports to have been written; the spirit of the Constitution to avert anarchy and ensure the continuation of order, peace, good governance and our fledgling democracy; the overwhelming need to have the Vice- President hold the full authority of the office of "President of Nigeria" until we know what has become of the constitutional President, must now prevail over dogmatic interpretation of the letter of the Constitution. Udo is very correct.The Governors have no part to play in this matter.They are just trying to be relevant.For 78 days they didn't know all they needed to do was to lobby their 'nominees' in the FED.EXEC.COUNCIL and members of the Nat ASSEMBLY from their States.They should even have done it underground rather than this their show.The constitution is very clear on what to do to make Jonathan Goodluck Acting President and it is not within the Governors' purview. In Nigeria illegality more often than not supercedes legality. @ Countryman/all - 2 things: 1. Jonathan isn't daft - he will be told, no doubt, that (a). Parliamentary 'Motions' aren't laws; &, (b). If he falls for this 'banana' and arrogates to himself a status not founded on law then he will have made his own impeachment easy (so that 'they' can put in an 'appropriate' Vice-President - whereupon the long-delayed 'transfer' would suddenly become easy); 2. Jonathan should not respect this illegality. How can people who are supposed to be custodians of the constitution work round to subvert the Nigerian supreme law. I smell they want to impeach the VP for acting without legal backing if he swallows this pill. The northerners are bent on holding to power, so they have devised a way of putting Jonathan in a tight corner to deal with him. Imagine peole like Farouk, Bankole, Mark, northern governors being at the forefront of this move. South south people should resist this nonsense and insist that the provision of the constitution on the absence of the president or incapacitation of the president be obeyed and nothing more.

Is it not this same 1999 constitution that has done us more harm than good that we are talking about? Please o, even if it is the signatures of 50 million Nigerians that are needed for things to move forward in this country, let us do!!!

where nigerian students and NANS? Where on earth are National Association of nigerian Students and respective students unions of the universities, polytechnics, monotechnics,( or better still tertially institutions) in nigeria and ofcourse the Oposition?. They truely failed the common man and nigerians in general. These bodies are normally great instrument of change in this new era. Look at Iran and changes their students and opposition are forcing their rulers to effect. Here in nigeria, students will rather take to kidnaping, exam- malpractice,armed robery, 419s and ofcourse wasting the lives of the innocents through their fucking cult practices and rituals. The opposition could not even organise common demonstration peaceful or otherwise to register the non democratic standings of the PDP, Yaradua's wife and their hawks called kitchen cabinet. Otherwise , why should this free for cabals and opposition looting spree still continue till now? Shame on these selfish you Turai yaradua and her co looters.

"Do you see what you sow? Is it you who grow it or are We the Grower?" When farmers speak among themselves, they usually speak about the crop they grow. One may say that I am going to grow this or that crop, or the crop which I grew was good last and this year, and so on. Thus the farmer tills his earth, plants the seeds and grows the crop. But God says it is not you who grow. It is We Who are the Grower. In other words, the action which was performed by the farmer is attributed to God. Why? The farmer had to follow the system which God created for that crop to grow. If the farmer does not follow that system, the crop will not grow. So, the real Grower is God. It is He Who created the system and when man follows the system of God, in choosing the right soil, in planting the right seeds, in farming at the right time for a particular crop, that crop will grow. The appointment of the Leaders thus is not their action. It is God's action. They are only instruments in manifesting God's will. They only cast their votes. As the grower, the farmer who grows crops, only throws the seeds but God is the real Grower. But it was the punishment of God which was manifested at their hands. Lets agree Yar'Adua and the nation's Resources looters FEC are all gone? There NIGERIANS 2011 election is counting-down! Pray before you decide of a leader, and think deep before you casts your vote for them? So, the believers pray: `O God! Give us guidance. Tell us, whom You want to appoint, and we, in obedience to You, we shall cast our votes for him'. God loves NIGERIANS, it doesn't want Yar'Adua Umoru and his team to continuing his punishment over us all.

@okanu,this country is finished.In our days in the University (during the IBB era),the whole nation would have been on fire by now.If Turai had woken up with this type of dream in that era, she would have rebuked the demons responsible for such evil dreams not to talk of trying to actualize it.The great ABU militants would by now have grounded govt business in the North,the lions in Nsukka would have devoured one or two reactionary elements,while the great Armada in Ife and Ibadan will be trying to outwit each other as to who will deal a more fatal blow on the enemy.My Great Uniben would have sealed off the Ugbowo Road to ensure that there is no movement to the east, apart from marching straight to Ring Road to teach the idiotic House Members a bitter lesson.

@OKEREKE CHIGO: I agree with you because the present situations of our Country is really frustrating, But not to pray for Military solution, IBB and his boys were there for eight years. If I may ask you did you have golden opportunities (the freedom of speech) by then? Even the media house had problem during IBB regime, was it not IBB regime that murdered Dele Giwa, kidnapped Tell magazine Editor on his way to Church at present of his wife and kids? Dele momodu were amongst the luckiest to exiled, all because of freedom of speech and had said the truth. At 21st century we shouldn’t pray for slavery regime again in Nigeria.

The decisin of the UPPER chamber to ask Jonathan act is an illegality. Before today, the agitation has been deu preocess. Why political and not costitutional process? where is Bakare? where is Soyinka? where is Falana? In my opinion, the anti Yaradua elemrnts in the senate are only being selfish and not patrotic as they woul;d want us to beileve. The Governor's forum are even the worse selfish people. Before the next year General elections, Yaradua would have come back and let us see how things will play out. God bless our country.

People, let us be reasonable. This is perfectly legal. If the president is abducted and is incommunicado, will a nation go without an acting president. The president can only trasnmit a letter if he is able to do so. That he has been unable to do so for 78 days means that he is temporarily incapacitated which is even more serious than going on vacation. Therefore the senate declaration is a statement of recognition of the president's temporary incapacitation.

Wow!! I can't beleive what Im hearing from people of this great natioon. Nigerian politicians sucks!!. Why are we even debating this? The largest country in west africa is left with no leader for over 78days, Im ashamed and highly dissapointed in our so called democracy. If mr Jonathan was the sick president, Im sure it won't even take this fat cows a week before handing over the power to Yar adua. The senators and reps need to get off their fat behinds and do what is right for the country for once in their greedy lives. The whole world is watching and it is time to step up to the plate and certify Mr Jonathan as acting president or whatever you want to call it. ENOUGH IS ENOUGH!!

I think this senate president is very sick.Since he came to power, he has never said any sensible thing.These are the kind of numb skull leaders we will always get if elections are rigged in the future.How can the mumu senate president say that the CNN broadcast by the sick president is enough to serve as a notice to the national assembly.Na wao wonders shall never end. For the PDP the game is over we are waiting come 2011,if you try anything funny and try to rig the elections, all you evil men and women in the devils party will be consumed.Imagine a bunch of animals in human skin taking Nigerians for granted.This time we will fight all of you because the suffer don reach our bone.

Well, the decision by the senate, rather than reducing the political logjam and tension, is actually, putting more fire on it. Hope they (the senators) are aware that whatever decision taken by the so-called acting president without being sworn-in (officially) to that effect remains illegal and unlawful.

The game is not over, it is still unfolding. The right thing should be done in making Goodluck the acting president. As far as I'm concern we still do not have a president. Let the rule of law " his Mantra" be followed. He should be IMPEACHED forthwith. QED.
