Group asks UN to hold session on Nigeria

Forty-two days after the Nigerian president, Umaru Yar'Adua, left Nigerian for medical treatment in Saudi Arabia, a group has petitioned the United Nations to hold an emergency session on Nigeria.

The Socio-Economic Rights and Accountability Project (SERAP) on Sunday, December 3, asked the United Nations Human Rights Council (HRC) to hold a special session on the non-compliance by the Nigerian government with its obligations in relation to the realisation of economic, social and cultural rights for its citizens.

A legal responsibility

The petition, signed by SERAP's executive director, Adetokunbo Mumuni, asked the HRC "to urgently consider the deteriorating economic and social rights situation in Nigeria due to President Umaru Yar'Adua's prolonged absence from duty, and his failure to empower the vice president to act as president to sign and effectively implement the 2009 supplementary budget, and the budget for 2010." The organisation argued that Nigeria, as a state party to the International Covenant on Economic, Social and Cultural Rights, "has a legal responsibility to use the mechanism of the budget to allocate and spend maximum available resources to ensure the full enjoyment of the rights to health, education, food, water and housing by millions of Nigerians who continue to live in extreme poverty, with barely enough to eat.

"The present situation in Nigeria is also contributing to the violation of the fundamental principle of non-discrimination and equality, which is essential to the enjoyment of economic, social and cultural rights," Mr. Mumuni said.

The body contends that extreme poverty has resulted in pervasive discrimination, stigmatisation and negative stereotyping of millions of marginalised Nigerians, "denying them access to the same quality of education and health care as others, as well as to public places."

It also adds that, "the Nigerian government has a responsibility to ensure that, through its budgetary allocations, strategies, policies and plans of action are in place and implemented in order to address discrimination in the area of the Covenant rights."

Starving projects

The organisation said Mr. Yar'Adua's absence and failure to empower the vice president to act as president, since his departure, as dictated by the section 145 of 1999 Constitution, is obstructing the effective implementation of the 2009 supplementary budget and the 2010 budget.

Mr. Mumuni claims that with this stated anomalies "at the beginning of 2010, retrogression in the realisation of these rights is apparent."

Quoting Section 145 of the Constitution, SERAP argues that the president has so far failed to empower the vice president as required by the constitution, "thereby starving critical projects such as education and health important funds and precipitating unnecessary delay in addressing the deplorable conditions of our roads, and worsening the security situation in the Niger Delta.

"This situation is also undermining the effective utilisation of a $300million World Bank (obtained from the International Development Association, an arm of the World Bank) facility for gas to meet the 6,000 Megawatts target," he said.

SERAP claims that the petition meets the requirements of the new procedure, and raises issues of importance justifying the holding of a special session on Nigeria."

SERAP has done well by petitioning the Yar 'Adua administration at the UN, but do they know even that UN has limited powers in Nigeria's affairs? When are they going to petition the One who has unlimited powers, GOD, to wholesomely intervene in Nigeria's dire situations? I think it's time we began looking up for true diliverance to Nigeria's myriad of problems. May God help us through this wilderness as He does the Isrealites.

Its clear that this SERAP is ignorant of the UN philosophy, articles, policies and modus operandi. Why do people report to the wrong agency for help. Mr. Adetokunbo Mumuni should not embarass himself, his organization and the Nigeria citizenry. He should first read and report properly. This Nigerian disgrace is getting out of proportion.

Common guys! Mr Mumuni dares to at least lend his voice in order to draw attention to our MANY problems and yet we run him down!!! This is the attitude we have (as Nigerians) that has kept us downtrodden for this long. Ignorant or not, if we Nigerians cannot get up and 'scream out loud' till the sycophants and thieves we have in government get the message, then let him (or her) who can be bold enough to act be free to do so without being 'gunned down'.

If the military strike, I think it`s better, because during the time of Buhari,IBB(respect), even Abacha, and there was no sharia but Nigerians enjoyed cheap and available fuel, power, education, health, e.t.c. Nigerians problem is surviving, we need a leader, military or agbada who have the struggling masses at heart.

I am tired beyond comprehension! Black (Nigeria) history? Battered, Black (Nigeria) present miserable and its ongoing, i pinch myself all too often asking if i am existing during these times. Dumb dumb...leaders, elders...everything, everybody Dumb. Unbelievable! I am angry with a leader who thinks more about some Northern or whatever agenda and not the teeming population that he should ensure don't face this kind of uncertainty (the kids, teeming youths etc) Our foundation is wrong wrong wrong and something must and will be done. The timing is just what's killing me! Foreigners here talk about how Africans can't take care of themselves, how they should all be sterilized and not allowed to bring children into a life of misery, how the "white man" should get back and colonize them for there own good? We continue to give them ammunition! We speak English (another peoples language when we have our own), we were artificially named and created yet we dumbly and blindly stroll along doing nothing about it? It beggars belief for me as 29 year old person from the area named by Lugard's girlfriend. Great cultures, peoples and languages (Yoruba over 30 millions, Hausa over 30 millions, Igbos over 30 millions etc) Dignity, respect, reason....what the hell is all this? I can't help thinking, this is the kind of stuff curses are made of. The more you loook the less you see and We have this immoral God this God that. Even leaders refuse to think but God that God this. Its almost like we have replaced the so called blind and primitive following of then primitive (as espoused by white people) beliefs with the same immoral and misplaced faith in not planning, not thinking, not acting and God this God that Whatever this guy is doing flagging the UN does us no good. Keep washing the linen out there with countries who have no real intentions for you and would continue to think..this sort of thing only comes out of the dumb people of Africa. I guess, mediocrity calls that we appreciate that he has attempted to do something.

What is happening in Nigeria is mind boggling! A tiny group of persons because of what they believe is 'Northern interests' hold mone than 140million people hostage. And there are people of other areas watching and clapping for them. The SERAP group made a bold move. If the other millions in Nigeria act in their own way, the situation would not have reached this level. The implication of all these is that if this hostage-taking group decides to recolonise us again through a military coup, they can manipulate and hold us till eternity. The Burmese(Myamar)lessons are still staring us in the face.

This is beyond man's understanding, i guess God is training someone who can take the position. but not withstanding Mr. Mumuni is right by expressing his grieve about our poor Government. Mr Mumuni has dared to do something, even if the agency is not the right one. Rather than complain,complain complain without any action, as it's the norm with an average Nigerian; give him a break. Let's support him by advising him on how to go about it, if you think you know better. Nigeria's situation is so pathetically shameful, now, that nothing Mr Mumuni, with his good intentions, can do that can make it worse. Mr Muttalab has done us the honours! 50 years after independence, a group in Nigeria finally puts a request forward to the UN to hold a session on Nigeria. Perhaps, this will open an avalanche for various other groups to follow suit. Well, if tons of newsprint, bytes of cyberspace and so much hot air (that is probably doing more damage to the ozone layer than from industries and vehicles) has achieved nothing, perhaps a special request for Nigeria's sovereignty to be supplanted by a special UN authority may be considered the smartest move since 1960. If the people cannot elect who they want, the president is nowhere to be found, no one is in control, the constitution is vague and 150 million people cannot move forward, then SERAP's cry might have been long overdue.

@U.B.A, I concur. Nigeria remains a british mistake that needs to be corrected. Until it is corrected, there isn't going to be any meaningful progress as a nation. The North should go with NIGER OR CHAD, THEIR ORIENTATION, RELIGION ARE THE SAME AND DIFFERENT FROM SOUTH AND WEST. ENOUGH IS ENOUGH LET'S SEPERATE PLSSSSSSSSS.....

Why pretend that there is no solution to this precarious situation the country finds itself? Nigeria is too large to wait for anyone to get well before moving on. There have been many coups in Nigeria, it's not as if jonathan's take over will be one. So what is saccrilegious about this? Fellow Nigerians, the solution is there but because the society abores the truth and justice the will is not forth coming. Besides Nigerians are too jealous of each other to a fault. They rather have foreigners milking us dry than have one of us benefit (which we called bad belle, pull him down syndrom, no be him only get head etc etc.). And what have we benefited corruption, bad image, murder, love of money and all evil in the book lurchs around us and society at large because of this. Isn't it a shame for just one man and his other criminal friends to willfully pull down a nation because he's dying in an hospital bed. How carlous and wicked to see many Nigerian lives been wasted through lack of electricity in hospitals, industries closed and homes (6000MW WAS PROMISED AND FAILED), accidents and carnages on poor roads dotted around the federation, poor sanitation and water have sent great many to early graves, Niger delta crises is waiting on the wings with potentials to cause many death, National melt down and anarchy threat on a daily basis. Nigerians are waiting for america to arrogantly tell them their nation is on the verge of collapse before they act. Nigeria of today is built by many selfless leaders of the past who are either alive or have died for the course of the nation or devotedly so. Only to be hijacked by the sycophants and mediocres we see in politics today. The very solution to this impasse is to constitute all law makers and the newly sworn chief Justice to summarily declare continous stay of Yaradua outside the country illegal and his nonchalance towards his job and the mandate of the people as unacceptable and unconstitutional(in other word have him fired for contempt of the people and constitution of the fedaration). No amount of sentiments and illhealth should outweigh the aforementioned, as no one will continuously allow a sickly worker in his company to stay away perpetually. Neither is any one, tribe, political affilliate is indispensible in Nigerian context. This has to be done NOW before it's too late. Nigeria, don't say you are not warned.

When will nigerians ever learn? Calling the UN for a session is irrelevant.A president is sick and so what? The right thing to do is to pray for him as a nation. SYNCOPHANTS will never tell Yaradua the truth because of their interest.Yaradua needs special care and rest from stress of 7 POINT AGENDA.When Abacha was in power, about one million people went to march and praise him. When he died, they were rejoicing. God will never give us good leaders without us changing our orientation and mind set. However, our leaders are too GREEDY, SELFISH, AND EVIL that their loot sometimes makes me feel their insane.Nigerian can be described as a Nation in possession of the SEA but the lack a CUP of water to drink.
