Bode George’s application for bail refused

Olabode George, the convicted former chairman of the Nigeria Ports Authority (NPA) board, and five others will have to remain in prison for a while longer. Their applications for bail were refused yesterday.

Justice Olubunmi Oyewole of the Lagos High Court in Ikeja, refused the bail applications, which were submitted on health grounds. He noted that the applicants could be granted bail on health grounds, however, they failed to provide concrete evidence to justify that they deserve to be admitted to bail.

"Health will on its own constitute a compelling ground but evidence based on medical grounds must be from an expert in that medical field," the judge said.

Issues/Argument of counsel

Olatunji Ayanlaja, Dele Adesina, Gbenga Ojo, Rotimi Sanni, Olutoyin Uko and Yinka Farohunbi, all counsel to the applicants, had filed an application before the court urging it to admit the convicts/applicants to bail, pending the determination of their appeal.

They urged the court to grant the applicants bail, owning to the fact that their notices of appeal containing the grounds for the appeal, have the likelihood of succeeding at the Court of Appeal. They also based their applications on what they said was the congestion of cases at the Court of Appeal; stating that the convicts would have served their 18-months term, according to the prison calendar before the appeal is determined.

Health grounds

They further based their arguments on the health conditions of the applicants; they stated that the facilities at the Kirikiri Maximum Prison cannot cater for the health needs of the applicants.

While Mr. George, a leading member of the ruling Peoples Democratic Party, was said to have hypertension and arthritis, the second applicant, Aminu Dabo was said to have a series of life threatening diseases, ranging from "compensated heart failure to complicated/chronic hypertension and renal impairment" which his counsel, Mr. Adesina, said needs weekly medical attention.

Prosecution's objection

The prosecution counsel, Festus Keyamo, in his counter affidavit and written submissions, urged the court to refuse bail. He noted that with the diligence of the counsel to the applicants, the appeal can be disposed off within a short period of time.

Mr. Keyamo also stated that the medical reports attached by the applicants were from private doctors and not from any government-owned hospital or from the prison hospital. He noted that the doctors are not known specialists in those fields of medicine for which reason he urged the court to refuse the applications.

The ruling

In the ruling, which was delivered about 45-minutes after the argument of the counsel, Justice Oyewole submitted that the issue of congestion at the appeal court was not within his jurisdiction to comment on. "I will not comment on the likelihood of the duration of the appeal," he said.

He also noted that the absence or presence of the counter affidavits of the applicants are only to aid the court to exercise its discretion to grant bail for which reason he submitted that the grant or refusal of bail is at the discretion of the court.

Based on all the issues placed before the court, the applicants were refused bail by the presiding judge and no further adjournment was announced.

"Application failed and consequently refused," the judge said.

Hear the defense attorney of Monsieur George -"they stated that the facilities at the Kirikiri Maximum Prison cannot cater for the health needs of the applicants". Solid argument meaning the facilities can cater for the health needs of all their other colleague inmates who eat half done beans two times a day. Please give the men their prison uniforms joo.

Justice Oyewole, please keep him away from circulation for a very long while. It has not yet dawned on him that he is a prisoner.We will do better as a nation when thieves are humiliated and kept away to serve as a deterent to would-be thieves. There are hundreds of poor, very sick (some dying) ordinary Nigerians in our prisons who URGENTLY and GENUINELY need bail or (early) release on health grounds. The Ministries of Justice, the Chief Judges, the Nigerian Bar Association, the National Human Rights Commission, NGOs, human rights activists and lawyers, should take appropriate steps to assist such people.

Do you give bail to a convicted felon? Am at a loss here. I thought he should have applied for a stay of execution of the judgement first pending determination of the appeal as against this exercise in futility? Pls educate me if am wrong.

I really like the firm disposition of Justice Olubunmi Oyewole on this Bode George's case. We need more of him in this country. However, I have serious concerns over his safety. He should also be careful of the proverbial "Banana Peel". To Chief Bode George and his other Maximum Prison-bound colleagues, I say fare thee well God bless Justice Oyewole, God bless Nigeria

So Egbo Bode has all these chronic ailments all this while, yet he was able to coordinate a tsunami rally in 2007. He had arthritis, yet he was able to criss-cross the length and breath of this country campaigning for Yaradua as DG of his campaign organisation. So he has a heart problem all this while, yet he has broken the hearts of so many parents by snatching their daughters from the cradle. I never knew Boda Bode was sick really. He has always come across a immortal with incredible swagger. Now it is time to serve the nation as a prisoner, he suddenly became sick with a litany of diseases. Thanks Justice Oyewole, if Egbon Bode is truly sick, he really needs to sit in one place to take care of himself. That is what people who have arthritis do. Pls dont grant him bail.

Before he was sentenced to prison, I begged him to assist me in my business, he blatantly refused. Now let him rot in jail, family or no family.

Keyamo's conduct of this case needs to be watched o! He did not file a counter-affidavit. Why? George does not behave like a model prisoner. He receives a steady flow of visitors all day, including Ministers of the Federal Government, one of whom has responsibility for the prisons. He probably does not even reside in a convicts cell. Threats were made to the EFCC Chairperson. There are probably other facts that are not in the papers yet. Are all these not enough to infer the likelihood of undue influence by George once he gets out of jail. This man is a serial offender who disdained both the law and constituted authority and now expects to use the judicial system to spend time delaying his necessary stay in jail. Justice Oyewole has once again saved the blushes of both the judiciary and this incompetent lawyer whose specialty is soft sell newspaper lawyering and not forensic advocacy. His only saving grace is that George's legal team have a petently bad case. EFCC should take him off this case before the Court of Appeal embarrasses them and their lawyer, Mr. Festus Keyao.

Very interesting photo indeed – the only person not smiling or laughing in that picture is Bode George. In fact all his lawyers look like they’ve been out on a jolly. They obviously know a gravy train when they see one and intend to ride it for all it’s worth.

Boy George should take lessons from Al Mustapha and Bamaiyi on prison survival tactics. Surely he must have learnt that in the military.They have been there for the past ten years. With these guys in their custody for the past ten years, I do not doubt the capability of the prison authorities. In the same vein , I must praise the military institution for the good training on survival tactics.

Bail for what! We are even complaining that the sentence is toooooo small comparing what he has stolen. I think the Appeal Court will add more years for him if care is not taken. We are appealing to EFCC to recover the said amount from these thieves before they come out of the prison. We were told that he is on hunger strike, I don't think so, he is just on "dry- fasting" so that the Appeal Court Judges may change their minds and grant him bail.

It seems that the judiciary system is also in a mess. Where are his handcuffs and prisoner's uniform please! If the judiciary system wants us to believe that he is indeed a prisoner, he must have been in prisoner's uniform and handcuffs visiting the court. Does he belong to the “Federal Republic of Nigeria” or the “People Republic of Nigeria”?

It is now cleared that we can sanitise our society off corruption.About N80bn missappropriated could have been used to develop power, provide health facilities as well as improving the societal weel being of Nigerians.If Bode George (The Prisoner)spends N5m/day,he will spend N1.8bn per annum.If he has 20yrs left on earth, he would spend N36bn.At his age,he is not a good example to PDP and the region he came from. @ Joseph Monehin, this is my own beef with Keyamo ( EFCC), it is obvious to everybody that the man Bode stole all these moneys and he was charged to court on more than 10 counts of corruption, diversion of funds and embezzling (in lay terms), yet keyamo and EFCC could not present a well researched case and so the Judge had to acquit him of all the charges, and just found a little administrative issue to deal with him.Is n't Keyamo supposed to be a really brilliant Lawyer or was he just brought into the case? So no money will be recovered from the Elder thief and after his 18months he'll still be a rich bastard.

What is 18 months that you can not serve out and purge yourselves of nothingness of this world? Siners shall not go unpunish, let him continue to face the consequences. Bail application? for a criminal like him, EFCC should issue another Writ to ask him to refund all the stolen money, if this is not done, that means anybody can do same thing even worst than that and have it at back of his mind, that if he caught, he would only go for 2yrs inprisonment and come out to be enjoying the money.

@olumide That EFCC (and Keyamo) were able to secure a conviction at all is a significant thing in this clime given the history of this country in prosecuting corrupt politicians. The truth is that this sentence passed omn Bode George is the maximum anyone had ever secured from the law courts to convict any corrupt politician since the establishment of the EFCC. Compare this to sentence meted out to Almieyeseigha and Tafa Balogun, or the plea bargain of Lucky Igbinedion, and you will know that this is a case of a half-full cup. And meanwhile, how did you decide that Keyamo was to blame if the judge gave a light sentence? Why not blame the judge?

Sincerely, I expected EFFCC and Festus Keyamo to file their own appeal by now. Are they saying justice as been done by sentencing someone that stole as much as 84billion just two and half years in prison without money refund? No! The judgment should be contested in the appeal court by EFFCC and Keyamo, the money should be refunded with full interest over the years, only on this is justice assumed to be done. Anything short of this is charade.

All these our so called big men who only claim illness when prison stares them in the face! Please let them go to jail and enjoy the facilities there. When they were in power they were content to plunder the nation instead of fixing the prisons and hospitals and making them standard. I'm certain they wish they could travel abroad to serve a prison sentence, the same way they could travel abroad to treat common ailments! I pray the Court of Appeal refuses them bail also, so they can finish their prison terms even before the appeal against their conviction is heard. They should even be glad the terms are short.

Celestine Chibuzo, I'm sorry. I was so angry with that Keyamo that I got my grammar completely mixed up at the end. I know he's the EFCC lawyer but if you read the news story in full, you'll realise that he placed no contrary facts before the court and came to argue only law. yet there are lots of facts available to show why George has no chance of bail. If Justice Oyewole was so inclined, he would have had a foundation to gtrant bail. Ultimately, it was the weakness in George's medical papers (the doctor that wrote that report George brought to court should be investigated) that decided the matter, not the strength of Keyamo's riposte. That old crook has a totally useless case (and his lawyers know it) but Keyamo should know that cases in court are not won based on how bad the other side's case is but on how good one's case is. As a lawyer who would like to see a lot more corruption cases end in convictions and stiff sentences, and having read the judgment in full, it seems to me that Keyamo is interested in this case only for the publicity. He does not appear to be doing his homework at all.

May you live long and well, may your tribe in the judiciary( and Nigeria as a whole) multiply and may we all live to see the Nigeria that people like you are trying to create. As for that yeye man, they should throw away the key to his cell and forget him there. Enough is enough and the day of the owner is finally here. Can the Senate please make sure to get Justice Oyewole as the assigned judge when they decide to go ahead with the prosecution of Anenih(or is it Anini?) so that Bode George can have good company and they can both reminisce about the old days. We, the long suffering Nigerian masses, are all eagerly looking forward to this day!

Olumide, no point arguing with Joseph Monehin. He too has definitely not done his research. I have nothing personal against Keyamo but reading all these posts demonstrates unmistakable public opinion that 2 years in jail does not meet the gravity of the serial offences committed by George and his motley crew. Keyamo is partly to blame for this inappropriate sentence because his handling of the more serious corruption charges was decidedly shoddy (there is a stronger word to use but not here) and the convicts got off scot free on those counts. Now, Keyamo's frequent pontificating in the newspapers would make a non-litigator think he is the new Gani Fawehinmi. Having practised for well over 2 decades, 14 of these litigating in every superior court in NIgeria across the country, I think I know a "Hollywood" (or is it "Nollywood"?) lawyer when I see one in action or I read a thorough judgment that assesses his performance dispassionately, as happened in this case. This case proves beyond a shadow of doubt that Gani's shoes are for now far too big for Keyamo. Bottom line: Read the judgment. Keyamo, if he conducted the prosecution, did not do a good professional job and that is an incontrovertible fact. Looking forward, it would be interesting to know what EFCC's instructions on the appeal will be. I hope that there will be a cross-appeal against the concurrent sentences on the basis that the offences for which George was convicted (disobedience to lawful orders) were serial and so egregious that concurrent sentences all amounting to 2 years (which in prison terms is actually 16 months, by the way, since most inmates get 4 months off for "good behaviour") do not actually serve the purpose of punishment. 1 year for each offence, sentences running consecutively (the offences were mostly committed consecutively, don't forget) will do very nicely for most of us. I also hope that EFCC will brief a more focused, more professional lawyer to handle this appeal. Enough said.

the joy of reading topical news items on Next is in the commentaries. they come in various dimensions depending on the subject matter. however, i have never read any news article that unites Nigerians like this one. friends, family and foes are all united in condemnation of this highly ungodly thieves of the commonwealth of Nigerians. Do remember to do istigfar all through your stay in prison, particularly aminu dabo and the other board members who have become partners in crime. this is indeed a lifetime opportunity to repent.

God is great.But let us be cautious how we jubilate even when our enemy is caused to fall for He says" rejoice not so that my anger may not be turned unto you".Bode what GOD requires from you is real repentance and purification of your conscience.Even the so glorified pastors in our mist today are doing the worst evils in multiples of yours.If only the modern day pharisees and Sadducee among us could be put in their proper positions,we would have the progress so elusive to our country.

May be you never tire for Bode-made suffering. If you de pray for Bode and co, you may be wasting your time. God say some people's heart have been seared with hot iron and that they are past feeling. @omoalhaja...we all know say dis na arrangee prosecution... keyamo is an unserious person..he should have been brought up for prosecutorial misconduct..at least efcc should not use him again...how much did it cost the government to get a 16 month sentence with no restitution?

Judging from the clause above which stated thus: "The facilities at the Kirikiri Maximum Prison cannot cater for the health needs of the applicants".simple implies that some Citizen are better than others, if the prison facilities can cater for other inmates then why not Bode! For crying out loud he is a prison and be treated as such.

@Amode I.T. This is place is not for religious people but honest and practical minds. You can go to Afghanistan or Iraq to preach to the souls there.@OmoAlhaja: though am not a lawyer common sense suggests Keyamo did a below average job.How on earth could a big thief like Bode Geoge and his gang walk out free with our commonwealth of N84B in their accounts. I wondered if a spurious Judge would not have set them free out rightly. Festus is more of a Television Lawyer and EFCC should help get him better litigation lawyers to help at the Appeal court, in fact I could help with recommendations. EFCC, Bode George and his gang must return our N84B and must serve out their jail terms, hence the suggestion to get better professionals to help Keyamo. This case MUST not fail Nigerians. We are watching.

Who does he think he is? He should remain in that prison, infact his own portion of place should be the worst in that prison. Afterall some of the prisoners there are even than he is after all he has done!! If he is granted bail then for sure we'll all know that our judiciary is the worst in the world because he does not deserve even to be shown the sunlight for years. PLS PUT ON HIM THE PRISON CLOTHES AND NEVER LET HIM OUT AGAIN BECAUSE HE MAY CONTAMINATE OUR CLEAN WATERS!

I am an eye witness to what happens in our prisons.some inmates die of ailment that are beyound the comprehension of prison doctors yet they are not refered to private hospitals for proper medical attention.bode should arrange for a private doctor to cater for his health need as the wife have been catering for his feedings
