Court sentences Bode George to 2 years imprisonment

The former Nigeria Port Authority (NPA) board Chairman and a Chieftain of the ruling People's Democratic Party (PDP), Bode George, was on Monday convicted by Justice Olubunmi Oyewole of the Lagos High Court.

Mr. Oyewole sentenced Mr. George and four other former board members of the NPA to two years each on a seven-count charge and another six months each on a 28-count charge.

The seven-count charge included abuse of office, while the 28-count charge was on wilful disobedience to lawful authority.

Sentenced with Mr. George were former NPA Managing Director Aminu Dabo, Olusegun Abidoye, Abdullahi Aminu Tafida, Zanna Maidaribe and Sule Aliyu.

History of the case

The former South West deputy Chairman of the PDP was charged by the Economic and Financial Crimes Commission (EFCC) in 2008 for contract inflation to the tune of N84 billion with five other board members, during his tenure as the Chairman of the NPA board between 2000 and 2003.

Giving evidence in court on January 22, 2009, a member of the committee set up to investigate the allegation of fraud leveled against the accused persons and a Chief Detective Superintendent in the EFCC, Bamanga Bello, said: "We found that there were irregularities in the award of contract by the Board of the NPA between 2001 and 2003.

"Contracts were split and inflated by the Board and advance payments above the 25 per cent limit approved by the government were made in the award of fifteen contracts," he said.

Mr. George and the other former board members first appeared before the state High Court on a 163-count charge on August 9, 2008.

According to the charges, they were alleged to have, among others, conspired about June 6, 2003 to inflate the contract price for the rehabilitation of Kalmar Container Handler from 215,555.52 Euro to 269,965.71 Euro.

They were also alleged to have inflated contract awarded to Dateks Ltd for the replacement and installation of six 11KVA High Tension Panels with accessories at Sub-station C, Tin Can Island Port, Lagos, from 310,500.40 Euro to 345,925.00 Euro.

He is supposed to spend the next 18 months in Jail of which a few weeks will be spent behind bars and then he'll be released for good behaviour afterwards. In a few years, some of his boys will come to power and he will be pardoned for the wrong conviction and the judgement overturned. Watch out for the next sequel for this drama.

I am almost certain he will not be serving a minute of this sentence. The Nigerian society needs to stop hero worshipping such thieves and call a spade by its proper name. Punishment should also mean that in order to serve as a deterrent to others. If however you are able to get off because of the amount of money stolen, or some position held, then others will line up behind him for their opportunity to steal even more than Bode George.

For those who are worried about the length of the sentence, at this stage of Bode Thomas life it's not the money that he is bothered about but the fact that he cannot command a sphere of influence among the Power Brokers. PDP in Lagos and the Southwest will automatically dump him and realign with a new Party Leader. Another sign of the ongoing battles between Yaradua and The Obasanjo Boys!

2 years for stealing N84 billion. And that is to run concurrently which implies he has already served one year. In other words, he is getting ONLY 1 year for N84b. These judges and politicians actually believe that Nigerians are idiots. How many Nigerians are awaiting trial in Nigerian cells for several years now for crimes as minor as fighting, wandering, stealing food/food stuff, pilfering from super markets, etc.? The next thing we would hear now is plea bargain after which our honourable Bode George would pay a token for the 1 year sentence and just go home a free man. What a justice system! Justice in deed is in the interest of the mighty. If 2 years is what you get for a 35 count charge which includes stealing N85b plus a chance for a plea bargain, then why shouldn't they be more thieves in public service. A lot of Nigerians would be only too glad to serve 10 years behind bars for ONE billion naira because after all they have already lived like prisoners all their lives. So please Nigerians, let us not get carried away by the apparent justice we see. IT IS GROSS INJUSTICE.

I hope he serves his time, two years may not be adequate but it would be an even bigger insult if he doesn't serve the sentence in an actual prison. All that rubbish about health problems (like Alams) should not be allowed yet again, otherwise the whole process of people getting charged to court, tried and sentenced is really a waste of public funds.

Victory for the rule of law and the judiciary. He must be made to serve his term like any other criminal/prisoner. The EFCC should prepare for appeal cos he and his board members are shameless and as a matter of right will appeal the judgement. I hope other public officers will learn from this. However, the justice system seems slow and when justice is delayed, it is as good as been denied. The NJC should ensure speedy trial and conclusion of cases involving corrupt public officers. Nigeria shall be free again.

He'll probably first get a stay of execution pending appeal, and then spend the time he should have been in jail partying outside while his expensive lawyers continually look for ways to make sure he does not ever get to spend the time in jail, especially considering the manner our Court of Appeal and Supreme Court pick dates. Hold on --there all!!!!! Dont rejoice yet. We have crooked laywers will get him out soon with an appeal to a higher court. Its high time the heat is turned on those corrupt lawyers too. The justice has tempered justice with mercy.I think a journey of a thousand miles begins with a step.This may scare some but where is the money? 2years is too short a time.He can still come out and enjoy his stolen wealth for PDP and his family, which would have been utilized to better the lots of this country.I hope this may end up like the cases of Tafa balogun.Kudos to the judiciary and rule of law.

The length of the sentence even though appears to be a slap in the wrist is indeed a welcome development. For long people like Bode george have lived larger than life and potrayed themselves as untouchables. It takes a courageous Judge like Justice Oyewole to look at people like Bode George in the eyes and put them where the rightly belong in jail. @ Tunde, He was sentenced 6 months for each of the 28 count charges and and 2 years for each of the 7 count charges. But the Judge said the jail term will run CONCURRENTLY. This is the judicial arithmetic: 28*1/6YEARS+7*2YEARS+(CONCURRENTLY) = 2YEARS and not 28 YEARS!

After Tafa Balogun 6 months sentence for stealing over N20 billion, this ridiculous 2 years sentence for stealing N100 billion is a go-ahead order for the intensification of corruption-competition. I have not seen the Court's record but assuming it is true that Bode George was just given a pat for stealing 84 billion naira,the commonwealth of the garri seller,okada man,"pure" water seller and the suffering Nigerian masses,then as a lawyer myself i would be very shocked at the 2 years jail term,said to run concurrently.There are enough provisions in the Criminal Code or our criminal laws that provide for financial restitution and compensation to the State.This is a sad day for the Nigerian Judiciary and it is an open encouragement to others to steal billions and go free after spending few days in prison.It is a shame that the Judicial system seems only active and enforce the full extent of the law when it is a case involving the ordinary Nigerians.One day we would all face GOD,where the FINAL AND IMPARTIAL JUDGMENT WOULD BE DELIVERED.

This is great! I wish to say that Bode George is no mean person.Eventhough two years may seem a short and light sentence,at least, we are seeing a new beginning in this conviction and in the war against economic crimes and corruption. Just as some mischievious lawyers always try to use the infamous rulings on Ibori and Odili regarding the jurisdiction and perpetual injuctionr egarding their cases,i hope this will serve as a rallying point and referrence to judges and lawyers for more convictions. How can a State court have jurisdiction over NPA a federal institution? Also the first judge that was trying the case was forced out by the AC government and this new judge was assigned to deliver the verdict they wanted. Go through the court transcript and you will see it's all rubbish. The reality is Bola Tinubu at work while the public gets taken for a ride. We seem to forget that this man is a big time thief who carted away government properties in Ondo State after his tenure as military Governor in the 90s and nothing happened. He and his cohorts will look for a way to compromise the justice system at the appeal and supeme courts. The only good thing in this jugdement is that he is at least humilated and if the jugdement sticks, he will not be able to hold public office again. Kudos to the Judiciary for living upto expectations. The Phd(Pull him/her down) syndrome holders who do not see anything good in EFCC can now see clearly for themselves that EFCC though not completely there yet, is working. But I have expected that somebody will ask the judge what will happen to the proceeds of crime? Is Bode George coming back to enjoy it or are the proceeds already confiscated? Why is it that a thief who stole goat or a pipeline vandal gets more years in jail than the man who is convicted for stealing millions of naira that could have saved lives in the hospital and the roads, provided electricity, supported education, etc. I hope the judiciary at the level of appeal Court and the Supreme Court will uphold this judgement or better increase the punishment.

He walked into the VIP lounge of Lagos Airport with SWAGGER proclaiming that he is not a wanted man and how Tinubu's media was the one spreading the rumour that he is on the run. He dared the EFCC to arrest him, he sued newspaper and magazine companies that told us how he was more sleezy than the Italian Mafia, He hosted his birthday party within the premises of a court, he harrassed those that came to testify against him, he hired Aso-ebi wearing party members/women to constitute a nuisance within the court premises and held court for favour seekers within the court premises. Kudos to the judge for having the guts to follow through and hand out this judgement to the "high and mighty" Bode George. As for all those who are saying two yrs is nothing, did they ever even believe Bode George could have been jailed in Nigeria at all? My people, na softly, softly catch monkey. Allegations of looting, thuggerry and election malpractices against the PDP was quelled with "automatic alacrity". The growth and influence of PDP was phenomenal.Many left their derelict parties to join the party of the day. Obas in Yoruba land were jostling to turban the lagos boy as chief. But alas the Lagos Boy has passed. Not that he is dead but he will go to this Jail if is the will of God serve his term but he will be vindicated . He will come out stronger and a better lagos boy than he went in. Going to Jail is no big deal, it is a university of its own. The who is who have been there . It is like Harvards and the Oxfords. it is like Kuru in plateau state. Soyinka, Obasanjo, Diya,Cecelia Ibru,Gani, Femi Falana, Anini, Asari Dokubo,Idiagbon, Bashorun Abiola, Lateef jakande and many more. Even though people go there for diffrent reason the bottom line is that as a Nigerian Prison Alumni the lessons are learnt and the stigma does not last. They say tough times dont last but tough people do. I beleive the Atona is a tough man and he will go there in style and teach those prisoners a lesson or two and that will put all his detractors to shame. The beauty of it all is that for a couple of billions and homes around the world the Atona can come back and retire to enjoy his wealth with his beloved family.

this judge really has guts. without an option of fine. this is good. i hope the judge had delivered that he refunds the money. it was not stated if he actually pocketed the money. however, for him to have splitted the contracts in order to avoid them being over his limit means the companies he awarded those contracts belong to him and his friends. this is what happens dailiy in our public offices. shameless leaders. maybe PDP just sacrificed bode in order to provide a smoke screen that they are faighting corruption. let them bring ibori, odili and igbinedion to book who are the real thieves.

Is this man in jail for 2 years or 28 years? I suppose this concurrency ruling is not a good thing. He should serve the terms separately such that he is behind bars for 28 years. This 2 years of a thing will only make a crime (involving billions of Naira) looks petty and thereby encouraging others. However, we are happy that at least one of the enemies of this country has been taught how not to be corrupt and pervasive. The Judge should have added the usual legal subjoin "with hard labour" to the judgment so that at least, he suffers a little bit before regaining fredom. Also begging for anwser is the question of recovering money that might have been stolen in the process. Never seen that done by any news medium in this country, including NTA. As I write at 10:30pm, ThisDay is still running a one-liner telling us what we have known since noon. Definitely, Next Newspaper is to the news business what Gani Fawehinmi's Nigerian Weekly Law Reports are to the legal profession. On this significant decision, some observations. The trial started in August 2008 and judgment was delivered 14 months later. Not bad. The system can be made to work when you have the right target in your sights. Second, all the offences were consecutive or committed in a series one after the other. So, why is the punishment concurrent? Third, most of the contracts were for contracts in the Apapa Ports Complex. There is a belief amongst the maritime community that successive NPA boards and management (dominated by Westerners) have enforced a deliberate policy of investing in Apapa Ports to the detriment of other ports in the Delta and the East. These charges clearly reinforce that belief. Fourth, almost none of the contracts are in Naira. Fifth, most of these ports are supposed to have been concessioned to private operators. If so, why is NPA that was meant to be a regulatory authority still involved in day-to-day port operations. These corrupt practices didn't start and will not end with Bode George and his NPA board members. They have been going on since 1960 in every single parastatal established by the Federal Government of NIgeria. Also, it is impossible to pull off these twisted deals without the active collaboration of staff members of NPA and civil servants in the supervising MInistry, as indeed was the case here. Now that these people have been convicted, will there be an investigation to find out and punish their staff collaborators? In this regard, the Judge made the interesting statement that PW 4, a Director in the civil service, "may be classified as an accomplice". The Judge also found that PW4 participated in the board meeting where the criminal intention to disobey a lawful order was "consummated", and thereby became "participes criminis" (a criminal participant or an accomplice). But the Judge turned round to say that credibility of such a character was not in issue, instead of observing that the Attorney-General's failure to charge PW4 is not only regrettable but is extremely objectionable and suspicious. On reasons for the Court's decision, the charges of inflating contracts was found not proved because the prosecution DID NOT present required documentary evidence of such inflation, even though it was clear that such evidence existence. Was this a genuine oversight, a deliberate lapse or a case of crass incompetence? Similarly, of all the numerous charges of contract splitting only 6 were found proved. For all the others, there was no evidence that the alleged split contracts were for the same equipment or could have been undertaken as a single contracts. Certainly not a great display of procedural or trial nous from Mr. Keyamo, whose newspaper flamboyance does not appear to have transferred fully to this trial. The Judge went on to find, quoting Section 7 of the Criminal Code that Bode George and his crew, by not inquiring carefully into how these contracts were presented by their subordinate officers in NPA, were guilty of an omission that enabled the commission of an offence (contract splitting) and therefore guilty of contract splitting itself. The Judge also found as a fact that Bode George and his co-directors were guilty of conspiracy to commit the offences found against them. Bode George's spurious defence to these charges is puerile. he contended that complying with the FG Circular on approval limits would have had dire consequences for the national economy and the national interest, i.e., the limits were too low. The answers to such a self-serving and unintelligent defence lie in questions like the following: why did you not write to the President and the FG economic management agencies warning them of these dire consequences? Why did you not wait and seek clarification? Why did you not resign if you found that you were being compelled by the FG to act against the national economic interest? All in all, I really don't see how the High Court judgment will be set aside on appeal. Bode George is definitely jail bait and I doubt that anyone except his hangers-on will cry for him. However, the failure to charge the civil servant, PW 4, Alhaji Wali Mansur Kurawa, to me is a professionally incomprehensible decision but one which is politically very obvious. This fellow, representative of the supervising Ministry sat there and did nothing while FG circulars were DELIBERATELY disobeyed. If silence means consent and ignorance is no excuse (assuming a senior civil servant can claim ignorance of a circular transmitted by his own Ministry), and the law is no respecter of persons, it is difficult to justify the decision not to charge the "see-no-evil civil servant" along with Bode George & Co. I wonder whether Mr. Keyamo, the social crusader advised against this clear case of "all animals are equal but some are more equal than others". Undoubtedly, Bode George is the undisputed target of a political plot to dispose of him comprehensively and to use the inimitable movie line: "They got him"!

Thank God nobody is talking about tribalism today! Every thief is an enemy of Nigeria no matter his state of origin. Justice Oyewole (who incidentally jailed Rev King) should be commended. It could not have been easy jailing a top-ranking (even if out of favour) PDP man. I don't mind 1 week jail term for him. I am just interested in being able to say Commodore Bode George rtd, ex-convict, psc. After defrauding Ondo State as a military governor, he was aked how he would like to remember. He said "that one Lagos boy passed through this place". When he leaves jail, I want it inscribed on the walls of his cell "that one Lagos boy passed through this place". Yes, it is the turn of the exponent of turn-by-turn politics. So the question is whose turn is it or who is next? I beg, where is C(t)hief James Onanefe I?

Next is right, Bode got 28yrs on several counts, but the actual time for him behind the bars is 2yrs+. We should all congratulate the Judge that gave the judgement. This is the dawn of a new day in Nigeria cos more heads are surely on the road to join Bode Judge in prison.

I am livid that some people will call this sentence an injustice, I know the judge who gave the judgement he is undoubtedly one of Nigeria's finest judges ever, many attempts on bordering on bribery had been made in similar cases without any compromise on he's part. I am happy something positive has come out of Nigeria. The judgement represents a wake up call for anti-corruption agencies and the Nigerian judiciary. Thank you Justice Oyewole, you courage is not in dispute.

Someone once commented that we Nigerians are so starved of anything being done so that when a little is done we get excited, I was very upset @ the time, but now I have to agree. Come on guys, 2yrs6mnths is rubbish and to add insult to injury the assets are not seized. We all know what happens when a thief is caught, one of the first things to be done is retrieve stolen property. Am sorry I can't praise anyone just yet, I don't see what has been done worth praising. I think there has been a lot of bad press for Government, what with Farida being embarrassed by protesters during her US trip and the falsified educational qualification of the President's in-law , they just offered Bode George as a sacrifice that's why the Judgement is incomplete, the Judge forgot that in a matter like this the properties of the "convicted" person (s) are seized.

There is so much motivation to steal public funds if 2years sentence is what a convict will get for stealing all that money!Anyway our leaders delibrately made the law like that,then long jail terms are awarded to criminal with less offences!I feel so sad.No wonder,they will not allow free and fair elections so that they can cover their tracks/continue their shameless stealing.When GOD repays them for their evils,we still pity them!

This is the beginning of the reign of justice in Nigeria. Thank God the judiciary is able to live up to expectation this time, and i will also use this medium to implore with the amiable EFCC to put up frantic effort towards ensuring that every other financial fraudster in the shoe of Bode George and his company are tried and jailed accordingly, especially when found guity of the crime by the court.

While some will consider it great that this common thief and his band of thieves are going to jail for 2 years for steal 84 billion naira, I see it as a very sad spectacle for the Nigeria's system of justice. It is merely a slap on the wrist and an indirect encouragement for the looting of public treasury to continue. The punishment has to fit the crime to make it credible, and hence serve as a deterrent. This sentence does not meet either of the two conditions. There has to be a way to completely recoup the stolen funds, and the convict and his family will never be allowed to benefit from the crime, and a stiff sentence (20 years to life without the possibility of early release) ought be imposed on these people who have betrayed the public trust. Anything short of these is a joke and an encouragement for further looting of public funds and property.

Hmmm, we are getting somewhere, if truly he goes to jail for just a day, then there is a future for Nigeria, at least we can then be trusting our judiciary system, but 2yr for 85 billion stolen.The next step is to arraign Babagida,Buhari,Obasanjo and all our past leaders and remove the STUPID immunity given them,a word is a enough for the wise,Nigeria shall RISE again.

This is the right way to run a country !!!!! Someone who STOLE over 84 billion naira sentenced to 2 years? People wonder why everyone steal from a corrupted nation like NIGERIA. I wish I'm in that type of position, I could stolen more that 500 trillion naira & serve 3 yrs. if not less. God punish you all in govt. position on behalf of the poor people of Nigeria.
