EFCC arrests communications commission boss

The Vice Chairman of the Nigerian Communication commissions (NCC), Ernest Ndukwe, was on Monday, arrested by the Economic and Financial Crimes Commission (EFCC) at the communications commission's office in Abuja.

The EFCC spokesperson, Femi Babafemi, who confirmed the development saying "he [Mr. Ndukwe] was arrested today and is in our custody."

He said Mr. Ndukwe is alleged to have illegally withdrawn the licence of the company that had won the bid for the supply of the nation's telecommunications Wi-max Services.

The spokesman did not name the company, however NEXT gathered from a source in the telecom industry that the NCC boss is accused of having withdrawn the licence granted to Galaxy Wireless, one of the forty companies that tendered a bid for the latest sale of a 2.3GHZ spectrum, and given it instead to Multilinks Telkom.

The EFCC's spokeperson confirmed that Mr. Ndukwe's arrest has to do with licences he issued without due process, saying he granted a controversial waiver totalling over N242 million to a company named Mobitel, which owed the commission N246 million.

Mr. Babafemi said the company which was able to raise the N1.3 billion licence fee in five days was subsequently granted the waiver, which enabled them to pay little more than N3million.

He is also alleged to have spent money in excess of the budget approved for the commission and also of collecting pension contributions which are meant only for employees of the commission.

These amongst other things were the basis for his arrest, Mr. Babafemi said. He however declined further comments saying investigations are still going on.


All three companies Galaxy Wireless, Mobitel Nigeria Ltd, and Spectranet Nig Ltd are said to have successfully submitted their bids, on the basis of which the licences were issued only to them.

NEXT investigations show that payment for the licences opened on April 30 and closed at the end of banking hours on Friday May 8, 2009.

Each of the successful bidders was required to pay a requisite sum of N1.3billion as the bid price.

According to the source, who asked not to be named, the NCC replaced Galaxy wireless with Multilinks Telecoms and issued the latter a licence even after payment had already been made.

Galaxy Wireless then protested in a petition to the Minister of Information and Communication, Dora Akunyili, whose consent was not sought prior to the bid offer.

The minister forwarded the petition to President Umaru Musa Yar'Adua, who ordered Mr. Ndukwe's arrest.

The Nigerian Communications Commission is the independent national regulatory authority for the telecommunications industry in Nigeria.

In order to achieve its mandate, the Commission also put in place the necessary licencing and regulatory framework for the supply of telecommunications services.

The commission also facilitates investment and entry into the Nigerian market for the provision and supply of communications services, equipment and facilities.

It is mandated to ensure that licences implement and operate at all times, the most efficient and accurate billing system, while also having the power to grant and renew communications licences in accordance with the provisions of law.

Dora Akunyili is a rogue and attention seeker.The allegations against Ndukwe is just another show of propaganda in Nigeria. Why is Ndukwe always targeted? What is it with this his job? Why is there suddenly so much attention on his job now that he has built up one of the most respectable government agencies in the world.Let the poor man be!!

This man allegedly committed a crime, we cannot let him be. Nigerians must resolve to fight corruption if they are to have a better life. ...But now, most Nigerians are hypocrites, they see somebody doing something wrong, they laugh with him, they celebrate him, he doesn’t know that he is doing something wrong. That is why I said that lack of integrity is deeper than we think. The root causes of poverty is corruption with its many heads example, but "Corruption breeds poverty, poverty breeds corruption" by Justice Ayoola is the type of joined up thinking that might help us all.

While no one is saying the EFCC shouldn't do its job, if the evidence against him is real and he's guilty then he must pay the cost! No mercy! The EFCC should however get serious and go after the really massive criminals that are holding this country hostage deciding who gets what in exchange for cash, everyone knows what they do, so why is EFCC afraid?

There is no gainsaying that under Engr. Ndukwe, the NCC grew to become one of the most vibrant Government Agecies. While one appreciates the fact that the EFCC has the right to take anyone to task whenever sharp parctices(s) is/are suspected, it is pertinent to advice that Mr Ndukwe is not sacrificed on the altar of some dirty 'politicking.' He should not be made to suffer for what he didnt do. If there are no clear cut evidence against him, Nigeria should not rubbish one of her best.

No matter what he has done in the past,as far as efcc is able to prove those evidences against him then he is guilty of financial crime,this country will not progess if will continue to judge people based on sentiment.

If Mr Ndukwe is found to be guilty, he should be dismissed and penalised. Same to heads of other government agencies. I don't understand why people here choose otherwise. That he has been effective in his assignment is no excuse to be complacent and act like he is alleged to.

Beauty, you want to fight corruption and you want to start with those changing the lanscape of Nigeria??? EFCC should focus on those crooks in the House of Reps & Senate that do not have any constituency except their pockets. Have they finished with Governors giving crazy contracts for white elephant projects? Have they finished with contractors that never finish their projects?? Have they arrested people indicted by the Power sector probe??? Rather, they are focussing on those trying to make things happen in the country. EFCC has arrested members of the Power Committee for fraud???? while those indicted by the probe are walking around??? Wake Up!!!!

Without doubt, Ndukwe is a hardworking Nigerian who has done so much for the telecommunications industry. This is a good opportunity for him to shame his adversaries and prove that he's a decent gentleman that will not abuse his office. So, let the law take its course please.

Mr. Ndukwe, over the years, has built the NCC into an institution of which we have had reason, in the past, to be proud. High achievement indeed, given the operational environment, where many friends are gained in high places when you actively work aganst the people. This is the environment in which the gentleman sought to play the role of ombudsman, protecting our hapless citizens from the flinty edges of the rapier of rampaging capitalism. The unconscionable rape, of gargantuan proportions, of Nigeria continues pretty much unbridled. This economic sabotage should be seen, and persecuted, for the act of High Treason that it is, seeking, as it does, to rob us all of our commonwealth and patrimony. By the same token, however, the pursuit of these enemies of the people, whose perfidies darken the lives of even future generations, should be focused, balanced, and vested with gravitas. The present hunt for Mr. Ndukwe may lack these criteria. As we seek to cleanse ourselves and sanitize our public service, we must keep guard against any attempts to politicise the struggle. Otherwise we'll find ourselves on a slippery slope to disaster, as we would, quite naturally, ensure by so doing that we keep away those with the need and capacity to work for a greater good; retaining those capable only of helping themselve- this would spiral us to darker disasterous depths indeed.

Professionalism is under serious threat in Nigeria.Let this case be benchmarked with the way Chief Adenuga lost his deposit during the first GSM bid.Ndukwe to the best of my knowledge is admirably transparent.Rushing to efcc though will help to unearth the truth behind this latest licence bid but caution should be exercised.Ndukwe is a professional of reference who have discharged his responsibilities with the art and science associated with corporate governance.His records should not be exposed to politics.

If the present EFCC will actual bring evil doer's in this country to book without fear of favour, i believe Nigeria will be a home for every one of us.It came to happen that the former EFCC boss was used for a purpose but i thank God that the reverse is the case.Where is he now? My advice is that Mrs Waziri should put her fingers cross so that Nigerian will have trust in her like we have in Mrs.Dora

dora akunyili is fast making herself a laughing stock i must say.the same yaradua has tactically refuse to order the arrest of the halliburton bribe cult.the truth is nigeria is in a greater mess than it was during obasanjo tenure. why did the same akunyili not use the halliburton saga to rebrand nigeria.this is one woman that doesnt know when to quit when the ovation is loudest/judgement should start from the presidency .

This is not a ballanced story. Why is there no angle from NCC? Reading this story, one would think Ndukwe is still in detention, the man was only questioned and left. Lets learn to ballance our story properly.

Madam Dora to me has done nothing except court publicity as she has always been doing.Thanks to EFCC at least if they cannot do anything about the Alliburton embarassment they can do something about NCC.Ndukwe's collaborators should shut-up.If he has done what he is acused of then he should be prosecuted but if not this should not be an opportunity to replace him with someone in their club

I won't say Ndukwe is corrupt or not let the courts decide that. But if his handling of the telecomms giants is an indication to his commitment to the cause of the county, then he's not done a good job at all. He has looked the other way while impoverished and already misgoverned Nigerians are financially raped & violated per seconds by the telecomms giants. One is only compelled to believe that with the enormous powers entrusted in his care he hasn't used it to protect the Nigerian people from the raiding & ravaging giants exploiting & shipping on per second basis part of our foreign reserves outside our shores at the slightest opportunity. One wouldn't care the least if the spoils were from efficient service delivery to their clients.

Ndukwe has done an excellent job in the Nigerian context. We now take the availability of telecoms for granted and have forgotten the dark days when NITEL held us hostage just as NEPA is still doing. It is instructive to note that the company Ndukwe is alleged to have given a licence to is a known active and competent telecoms player. Ndukwe should only be arrested if conclusive evidence of crime has been amassed against him. If he is only being questioned by EFCC as part of investigations then it should not be right to arrest him at this stage.

Is there anything wrong with the EFCC carrying out there job as being designated to in fighting against all types of crimes in Nigeria once and for all at all level without fear or favour,this should be a great example for all other crookks to get themselves alert that Everyday is always for the thief,but one day will definately for the owner. Their must be a reason for Ndukwe’s action. That is, if the allegations against him is true. So who knows that reason? and EFCC is not telling us why Ndukwe's action. Let us hope that all these allegation and defence is leading to a better Nigeria.

Why are we so sentimental and parochial about issues in this country. Why dont we allow the issues to be investigated, we do not have the full facts of a case and we have started giving judgements. If it is true that Mobitel could pay =N=1.3 Billion for the licence then commonsense dictate that they should be capable of paying the =N=236 Million debt to NCC which is a commonwealth.

I believe EFCC should stop majoring in the minor, also Dora should have first find out from NCC boss what led to the withdrawal of the license (if the was, in the first place) rather than working had to rubbish NCC (good records) Nigeria is now ranked high in Telecoms, about the only sector we have a good rating. Its just a pity that pull down our own to stand tall.

The earliest we realised public office holders do us no favour by their performance in office, the better for Nigeria. Much as I personally appreciate Mr Ndukwe's contribution, we must take note that the commission he heads is byitself a self sell having served the purpose of providing an alternative to the begging demand created by the failed monopoly called NITEL. Yet it bothers me to ask if Mr Ndukwe's headship of NCC has champined the best and most competitive services for Nigerians compared to what exist in other countries we are privilaged to know about the activities of telecom operators. Ndukwe had tried but should we not question some activities which may have resulted in the substandard services we experience. PLEASE LET ESCHEW SENTIMENTS AND LET FACTS GUIDE OUR JUDGEMENTS. Earnest Ndukwe is one of my favourite Nigerians however i detest evil and criminality. If indeed, the guy has lizards in his shelf. 'it' should be shown to him. My worry is that, it is become almost impossible for any fair trial in Todays' Nigeria. I pray Mr. ndukwe do not fall into the group of innocent nigerians who suffer for the rich. As regards madam Dora A. It is unfortunate that she has mixed credibility with political ambition. May God 4give her....whatever anyone sows....He/She must reap. I am out for now.

Dora should start by rebranding herself if we must achieve anything good in this country. i bet you, time will prove Ndukwe innocent of all this accusation. i will advice efcc to go after those big time thives in governors rope.

I don't know what to say but it will be quite disappointing if Ndukwe is found grossly wanting in all of this cos I do have a great deal of respect for him, since He is the father of the sector so he is better informed about it than most of us. I'll also say that Ndukwe has not done much in my sight to protect we consumers, though I'll say thanks to the CDMA's that is giving us some form of relief in terms of costs in making phone calls. In this sector experience, efficiency and reliability counts a whole lot and the experts know who is who. EFCC should go and catch this ex-governors, senators, Minister roaming shamelessly about with stolen wealth of the Nation and Leave this man serving us so far better than the re-cycled good for nothing we have as ministers. It's a shame that this Caliber of president can do nothing about The Oil cartels holding the nation to ransome then this one we know who is working is person he wants to hang. na waoh! my president think and act right oh!

Okay there is something I have to add to this conversation, having been doing some research in the market. This seems like the most insane political system as a Westerner looking in. Why the heck would I want to invest in your country? In any sane world, the court system would handle this. No arrests and no intimidation. Further, you cannot arrest someone unless a court allows it through a warrant. If the warrant is handled illegaly you have a supreme court you can appeal to. Not even the president/ prime minister can overturn the courts. It keeps things fair and unbiased. But not here.... In sa sane world...All you do is file a complaint, suing the government for damages. You have to prove that you have a financial loss because the government did something illegal. You take it to trial and then your done. Almost always you settle out of court if you have proof, because the defense folds. In this instance, the proof is either obvious or it's not. Plain and simple.... If this guy did this, which is a criminal charge, not a civil one like above, then he would just be put under investigation, temporarily suspended with pay, until the charges were heard, and then they would have a trial. No need to arrest anyone or use insane bullying tactics. But without a case to take to court, there would be no arrest warrant, and there would be ONLY one agency that would handle all criminal chargest (not competing agencies that fight each other over turf wars like you have in Nigeria). So until this system shapes up, I am not setting one foot in your nation. Sorry guys....this is assinine.
